And Others\nPetitioner Counsel :- G.K.Singh,Bheem Singh\nRespondent Counsel :- C.S.C.,K.P.Shukla\n\nHon'ble Dilip Gupta,J.\n<\/pre>\n<p>The petitioners have sought the quashing of the order dated 11th<br \/>\nJune, 2010 passed by the District Inspector of Schools, Agra by<br \/>\nwhich he has approved the decision of the Committee of<br \/>\nManagement of the Institution taken in the meeting held on 23rd<br \/>\nFebruary, 2010 for appointment of Girdhari Lal Bhagtyani as<br \/>\nPresident and Harish Lala as the Manager of the Committee of<br \/>\nManagement of the Institution for the remaining tenure.\n<\/p>\n<p>It is stated in the petition that the last elections of the Committee of<br \/>\nManagement of the Institution were held on 4th February, 2007 in<br \/>\nwhich Ashok Katariya was elected as the Manager. The term of<br \/>\nthe Committee of Management of the Institution is four years but<br \/>\nprior to the expiry of the aforesaid term, Ashok Katariya submitted<br \/>\nhis resignation from the post of Manager on 15th February, 2010.<br \/>\nThe President of the Committee of Management of the Institution<br \/>\nfixed an emergent meeting of the Committee of Management of<br \/>\nthe Institution for 20th February, 2010 for consideration of the said<br \/>\nresignation, but the Principal of the Institution notified that the said<br \/>\nmeeting shall be held on 23rd February, 2010. On the said date, the<br \/>\nPresident and the Auditor also submitted their resignations and the<br \/>\nmembers wanted to hold elections for the posts of Manager,<br \/>\nPresident and Auditor for the remaining tenure. The petitioner<br \/>\nobjected and walked out the meeting and subsequently Girdhari<br \/>\nLal Bhagtyani and Harish Lala were elected as the President and<br \/>\nthe Manager respectively for the remaining tenure of the<br \/>\nCommittee of Management.\n<\/p>\n<p>The petitioner then represented before the District Inspector of<br \/>\nSchools that fresh elections could not have been held on 23rd<br \/>\nFebruary, 2010 since no agenda had been circulated for the said<br \/>\npurpose but the District Inspector of Schools has approved the<br \/>\ndecision taken by the Committee of Management on 23rd<br \/>\nFebruary, 2010 since the casual vacancies were required to be<br \/>\nfilled-up.\n<\/p>\n<p> Learned Standing Counsel appears for respondent nos.1, 2 and 3<br \/>\nwhile Sri K.P. Shukla appears for respondent no.5. Learned<br \/>\ncounsel for the petitioners prays for and is permitted to delete the<br \/>\nname of respondent no.4 from the array of respondents. Learned<br \/>\ncounsel for the respondents state that it is not necessary to file a<br \/>\ncounter affidavit and the petition may be disposed of at this stage.\n<\/p>\n<p>The dispute has arisen on account of the resignation submitted by<br \/>\nthe Manager of the Committee of Management of the Institution<br \/>\non 15th February, 2010. It cannot be disputed that this casual<br \/>\nvacancy is required to be filled-up in accordance with the<br \/>\nprovisions of the Scheme of Administration of the Institution.\n<\/p>\n<p>The petitioners have questioned the manner in which this vacancy<br \/>\nhas been filled-up. It is the submission of the learned counsel for<br \/>\nthe petitioners that in the absence of any agenda for filling-up such<br \/>\na casual vacancy, it was just not possible for the Committee of<br \/>\nManagement of the Institution to have filled-up not only the said<br \/>\ncasual vacancy for the post of Manager but also for the post of<br \/>\nPresident in the meeting held on 23rd February, 2010.\n<\/p>\n<p>Sri Shukla, learned counsel appearing for respondent no.5 states<br \/>\nthat in such circumstances, instead of remanding the matter to the<br \/>\nDistrict Inspector of Schools for a fresh consideration, a direction<br \/>\nmay be issued to the Committee of Management of the Institution<br \/>\nto hold a fresh meeting in accordance with the provisions of the<br \/>\nScheme of Administration of the Institution for filling-up the<br \/>\nresultant casual vacancy on the post of Manager.\n<\/p>\n<p>In view of the aforesaid, the order dated 11th June, 2010 passed by<br \/>\nthe District Inspector of Schools is set aside. It shall, however, be<br \/>\nopen to the Committee of Management of the Institution to fill-up<br \/>\nthe casual vacancy on the post of Manager because of the<br \/>\nresignation of Ashok Katariya in accordance with the provisions of<br \/>\nthe Scheme of Administration of the Institution.\n<\/p>\n<p>The writ petition is allowed to the extent indicated above.\n<\/p>\n<p>Order Date :- 3.8.2010<br \/>\nGS\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court C\/M Swami Leela Shah Adarsh Sindhi &#8230; vs State Of U.P.
