1.The petitioner, an employee of the Fishery Survey of India,<\/p>\n
  was posted in Cochin. While working in the Cochin office, an<\/p>\n
  issue arose as to whether he was eligible for being considered<\/p>\n
  for promotion to the category of UDC.                   The issue was as to<\/p>\n
  whether a Hindi Typist should be treated as equivalent to an<\/p>\n
  LDC.   The petitioner moved the Ernakulam Bench of the<\/p>\n
  Central Administrative Tribunal. The Tribunal held that the<\/p>\n
  post of Hindi Typist is on par with Junior Clerks\/LDC and<\/p>\n
  accordingly ordered a review DPC. Review DPC was held and<\/p>\n
  it was observed that the petitioner was eligible to be<\/p>\n
  promoted. As a result, Smt.K.K.Ambika, the 4th respondent<\/p>\n
  herein, who stood promoted at an earlier point of time, was<\/p>\n
  reverted to provide room to accommodate the petitioner.<\/p>\n
  After so promoted to the category of UDC, the petitioner was<\/p>\n
  transferred to Mumbai. A question then arose as to whether<\/p>\n

                                 2<\/span><\/p>\n
  the promotion of the petitioner is to be made with effect from<\/p>\n
  the date on which Smt.K.K.Ambika, his admitted junior, was<\/p>\n
  promoted.     The petitioner made different representations.<\/p>\n
  Going by the stand of the establishment, though they would<\/p>\n
  attempt to justify their view in the matter, admittedly, they did<\/p>\n
  not issue any order on any of the representations of the<\/p>\n
  petitioner in this regard. Ultimately, the petitioner moved the<\/p>\n
  Ernakulam Bench of the Tribunal for relief.       The Tribunal,<\/p>\n
  however,    held that the representations having been made<\/p>\n
  while the petitioner was working in Mumbai and he being<\/p>\n
  stationed in Mumbai, the jurisdiction of the Ernakulam Bench<\/p>\n
  of the Tribunal could not be invoked. It was also held that the<\/p>\n
  claim is barred by limitation.\n<\/p>\n<\/p>\n
2.Having heard learned counsel for the petitioner and learned<\/p>\n
  Additional Solicitor General, we are of the view that the<\/p>\n
  findings of the learned Tribunal are totally misplaced. For one<\/p>\n
  thing, the right of the applicant, if any, to claim eligibility for<\/p>\n
  promotion with effect from the date on which Smt.K.K.Ambika<\/p>\n

  stood promoted was an issue that arose while he worked in<\/p>\n
  Cochin. He was kept out of the zone of consideration at the<\/p>\n
  first instance on the ground that he is only a Hindi Typist. He<\/p>\n
  agitated that issue before the Ernakulam Bench and pursuant<\/p>\n
  to the directions of the Ernakulam Bench, his case was<\/p>\n
  considered in a review DPC. That was also done while he was<\/p>\n
  working in Cochin. Therefore, the question of promotion of<\/p>\n
  the petitioner as UDC was an issue which arose, and he was<\/p>\n
  considered for such promotion, while he worked in Cochin.<\/p>\n
  His transmission from Cochin to Mumbai came only as a<\/p>\n
  transfer   generated   following    his  promotion    as  UDC.<\/p>\n
  Therefore, we are of the clear view that the Ernakulam Bench<\/p>\n
  of the Tribunal had the jurisdiction to decide on the matter.<\/p>\n
3.On the question of limitation, as submitted on behalf of the<\/p>\n
  establishment, there is nothing on record to show that the<\/p>\n
  petitioner’s representations referred to in paragraph 4 of the<\/p>\n
  Original Application have been answered by communicating<\/p>\n
  any decision to the employee.       When an employee makes<\/p>\n

  representations making certain claims, the establishment has<\/p>\n
  to take a decision, if necessary, after hearing the employee and<\/p>\n
  communicate the decision to him.         It is only thus that a<\/p>\n
  representation gets ultimately disposed of. We may also recall<\/p>\n
  that in terms of Section 20 of the Administrative Tribunals Act,<\/p>\n
  an employee has to first take recourse to the other available<\/p>\n
  remedies before approaching the Tribunal. Under such<\/p>\n
  circumstances, we are of the view that the plea of the question<\/p>\n
  of limitation is also misplaced. We, therefore, vacate the order<\/p>\n
  of the Tribunal.\n<\/p>\n<\/p>\n
4.With this, we would have normally remitted the matter to the<\/p>\n
  Tribunal for consideration further on merits in relation to the<\/p>\n
  pleadings on board. However, in view of Section 20 of the Act,<\/p>\n
  it is necessary that the establishment takes a decision on the<\/p>\n
  representations of the petitioner and communicates it to him<\/p>\n
  before he gets enabled to move the Tribunal, if ultimately that<\/p>\n
  becomes necessary.\n<\/p>\n

                                  5<\/span><\/p>\n
5.For the aforesaid reasons, preserving all rights of the<\/p>\n
  petitioner, this writ petition is allowed vacating all findings in<\/p>\n
  the impugned order and setting aside Ext.P1 order and<\/p>\n
  further, directing respondents 1 to 3 to ensure that the<\/p>\n
  representations of the petitioner referred to in the Original<\/p>\n
  Application in relation to the relevant issue are taken up by the<\/p>\n
  competent authority and disposed of in accordance with law.<\/p>\n
  We may also state that having regard to the fact situation,<\/p>\n
  there is no reason why the petitioner should be refused the<\/p>\n
  benefit claimed by him since an erroneously refused promotion<\/p>\n
  would at least generate entitlement to claim benefits, at least<\/p>\n
  notionally. Let a decision be taken and communicated to the<\/p>\n
  petitioner within a period of four months from the date of<\/p>\n
  receipt of a copy of this judgment. The writ petition is ordered<\/p>\n
  accordingly. No costs.\n<\/p>\n
