BASANT, J.\n            -------------------------------------------------\n                    B.A. No. 4882 OF 2007\n            -------------------------------------------------\n          Dated this the 13th day of August, 2007\n\n                               ORDER\n<\/pre>\n<p>      Application for anticipatory bail.         The petitioner faces<\/p>\n<p>allegations, inter alia, under Sec.420 of the IPC.          A crime has<\/p>\n<p>been registered on the basis of a private complaint filed by the<\/p>\n<p>de facto complainant and referred to the police by the learned<\/p>\n<p>Magistrate under Sec.156(3) of the Cr.P.C.             The crux of the<\/p>\n<p>allegations against the petitioner is that he fraudulently<\/p>\n<p>suppressed a charge relating to his property consequent to an<\/p>\n<p>attachment by the Family Court and induced the complainant<\/p>\n<p>to part with money.          Investigation is in progress.         The<\/p>\n<p>petitioner apprehends imminent arrest.\n<\/p>\n<p>      2.  The learned counsel for the petitioner submits that<\/p>\n<p>the petitioner is absolutely innocent.        There was no wilful or<\/p>\n<p>fraudulent suppression of any vital fact. It had been revealed<\/p>\n<p>to the complainant that there was such an attachment.<\/p>\n<p><span class=\"hidden_text\">  B.A. No. 4882 OF 2007        -: 2 :-<\/span><\/p>\n<p>Knowing fully well of the attachment, the complainant had taken<\/p>\n<p>the assignment of the property.       In these circumstances, the<\/p>\n<p>petitioner may not be subjected to the undeserved trauma of<\/p>\n<p>arrest and detention.    Anticipatory bail may be granted to the<\/p>\n<p>petitioner, submits the learned counsel for the petitioner.<\/p>\n<p>      3. The learned Public Prosecutor opposes the application.<\/p>\n<p>There is absolutely nothing to indicate that there was no<\/p>\n<p>fraudulent suppression of the fact of attachment which the<\/p>\n<p>petitioner knew, submits the learned Public Prosecutor.    The de<\/p>\n<p>facto complainant has been obliged to pay a huge amount of<\/p>\n<p>Rs.1,50,000\/-    to save   his property     from sale.   In these<\/p>\n<p>circumstances, this is certainly not a fit case where anticipatory<\/p>\n<p>bail can be granted to the petitioner, submits learned Public<\/p>\n<p>Prosecutor.\n<\/p>\n<p>      4. I find merit in the opposition by the learned Public<\/p>\n<p>Prosecutor.    In the facts and circumstances of this case, I am<\/p>\n<p>unable to perceive any features which would justify the issue of a<\/p>\n<p>direction under Sec.438 of the Cr.P.C. This, I am satisfied, is a<\/p>\n<p>fit case where the petitioner must resort to the ordinary and<\/p>\n<p>normal course of appearing before the Investigating Officer or<\/p>\n<p>the learned Magistrate having jurisdiction.    He must then seek<\/p>\n<p>regular bail in the ordinary course.\n<\/p>\n<p><span class=\"hidden_text\"> B.A. No. 4882 OF 2007          -: 3 :-<\/span><\/p>\n<p>     5. In the result, this bail application is dismissed; but with<\/p>\n<p>the observation that if the petitioner surrenders before the<\/p>\n<p>Investigating Officer or the learned Magistrate and seeks bail,<\/p>\n<p>after giving sufficient prior notice to the Prosecutor in charge of<\/p>\n<p>the case, the learned Magistrate must proceed to pass<\/p>\n<p>appropriate orders on merits and expeditiously.<\/p>\n<p>                                                     Sd\/-\n<\/p>\n<p>                                              (R.
