        writ   petition   is  filed   seeking   the<\/p>\n
following reliefs.\n<\/p>\n<\/p>\n
        i) Issue appropriate directions directing<\/p>\n
the learned District Judge, Kottayam to hear and<\/p>\n
dispose of the  petitioner’s Exts.P4 to P8 within a<\/p>\n
time  bound  frame   and  until   then  the   first<\/p>\n
respondent  may  be  restrained  from  cutting  and<\/p>\n
removing the trees standing in the schedule to<\/p>\n
Ext.P1 petition.\n<\/p>\n<\/p>\n
        ii)  Issue such other orders as are deemed<\/p>\n
fit and proper in the circumstances of the case.<\/p>\n

          2.     Petitioner has filed an insolvency<\/p>\n
petition as I.P         No. 3 of 2009 before the Sub<\/p>\n
Court, Pala to declare the first respondent as<\/p>\n
insolvent under the provisions of the Insolvency<\/p>\n
Act.     In that proceeding, petitioner moved an<\/p>\n
application for an interim injunction to restrain<\/p>\n
the first respondent from cutting and removing<\/p>\n
trees in his property scheduled in the petition.<\/p>\n
Initially     an   order   of  interim   injunction was<\/p>\n
granted, but it was later modified permitting the<\/p>\n
petitioner to cut and remove the rubber trees alone<\/p>\n
and   replanting      them.   The    order  thereof was<\/p>\n
challenged by the petitioner before this court by<\/p>\n
filing a writ petition and later noticing that a<\/p>\n
statutory appeal is provided under the provisions<\/p>\n
of Insolvency Act the writ petition was withdrawn<\/p>\n
with permission to challenge the order as provided<\/p>\n
by law.     By the time the appeal was preferred, it<\/p>\n
was barred by time and so much so, a petition to<\/p>\n

condone the delay was also presented.         The delay<\/p>\n
petition is pending enquiry.        Meanwhile the first<\/p>\n
respondent is taking hasty steps to cut and remove<\/p>\n
the rubber trees is the grievance canvassed in the<\/p>\n
writ petition for seeking appropriate directions or<\/p>\n
orders to the court where the appeal is pending for<\/p>\n
an expeditious enquiry and disposal of the delay<\/p>\n
petition and passing of orders on the appeal if it<\/p>\n
is entertained.\n<\/p>\n<\/p>\n
          3.        Notice  being   given,   the  first<\/p>\n
respondent     has   entered appearance.     Notice  to<\/p>\n
second and third respondents is dispensed as their<\/p>\n
presence is not found required for the disposal of<\/p>\n
this petition.\n<\/p>\n<\/p>\n
          4.     I heard the learned counsel on both<\/p>\n
sides.    At the time of hearing the learned counsel<\/p>\n
for the first respondent submitted that he will<\/p>\n

furnish an unconditional undertaking, to furnish<\/p>\n
security for a sum of Rs.5,00,000\/-, to satisfy the<\/p>\n
suit claim, when within two weeks, in O.S No. 169<\/p>\n
of 2008 in Sub Court, Pala,          which was instituted<\/p>\n
by the present petitioner seeking a decree for<\/p>\n
money on the basis of a cheque for a sum of rupees<\/p>\n
five lakhs purported to have been issued by the<\/p>\n
first respondent.       In that suit, on the application<\/p>\n
moved by the petitioner under Order 38 Rule 5 of<\/p>\n
the Code of Civil Procedure it is submitted an<\/p>\n
interim order of attachment before judgment has<\/p>\n
already been passed by the court attaching the<\/p>\n
property of the first respondent.            Cutting and<\/p>\n
removal of rubber trees from that property, it is<\/p>\n
submitted,      has    given   rise     to  the   present<\/p>\n
controversy      arising   for   consideration   in   the<\/p>\n
present petition.       It is further submitted by the<\/p>\n
counsel that the cutting and removal of the trees<\/p>\n
as per the terms of the agreement entered with<\/p>\n

another is essential to furnish the security for<\/p>\n
the suit claim of rupees five lakhs and so much so,<\/p>\n
he may not be restrained from honouring the terms<\/p>\n
of that agreement.         The learned counsel for the<\/p>\n
petitioner submits that he has no objection in<\/p>\n
disposal    of   the    writ  petition    subject  to  the<\/p>\n
condition     that   first   respondent    shall  file  an<\/p>\n
undertaking to the court below in the suit, before<\/p>\n
the Sub Court, Pala, within the time limit fixed by<\/p>\n
this court, as submitted by his learned counsel.<\/p>\n
It is further submitted by the counsel that on such<\/p>\n
undertaking being furnished, the petitioner will<\/p>\n
not pursuing the insolvency proceedings and also<\/p>\n
the appeal proceeded against the order from the<\/p>\n
interlocutory      application    which    is  now   being<\/p>\n
agitated     in   an   appeal   before    District  Court,<\/p>\n
Kottayam.       Submissions    made   by   the  respective<\/p>\n
counsel are recorded.\n<\/p>\n

          4.     Writ petition is disposed directing<\/p>\n
the first respondent to furnish the undertaking<\/p>\n
before the Sub Court, Pala, as submitted by his<\/p>\n
counsel,     to    produce   security     for a   sum of<\/p>\n
respondents.5,00,000\/- to satisfy the suit claim,<\/p>\n
within a period of two weeks from the date of this<\/p>\n
judgment.     The undertaking shall be given without<\/p>\n
delay and security as represented to be produced<\/p>\n
within two weeks.       Hand over a copy of the judgment<\/p>\n
to the counsel on both sides on usual terms, and<\/p>\n
transmit a copy to the Sub Court, Pala and District<\/p>\n
