1.\tThis
\nCriminal Misc. Application is filed under Section 482 of the Code of
\nCriminal Procedure, 1973, to quash and set aside the impugned F.I.R.
\nbeing C.R. No.I-134\/2009 registered at Jetpur City Police Station,
\nDistrict: Rajkot Rural for the offences u\/s. 506, 384 and 511 of
\nIndian Penal Code and the subsequent proceedings i.e. charge sheet
\nand Criminal Case No.53\/2010.\n<\/p>\n
2.\tThe
\ncomplainant who is the owner of a retail shop named as ‘Rupali Season
\nStore’, situated near Central Bank Station Road, Jetpur, is having
\nlicense to sell firecrackers during Diwali season. The present
\napplicant, on 30th September, 2009 around 12:00 p.m. came
\nto the shop of the complainant and started doing video-shooting and
\nprojected himself that he had come from Mamlatdar officer and
\ninquired about why firecrackers were kept illegally in the shop.  On
\ntelephoning  the office of Mamlatdar, the complainant was informed
\nthat no such person from Mamlatdar Office was deployed to the shop of
\nthe complainant and, therefore, no person was permitted to carry
\nvideo-shooting of the shop and belongings in the shop of the
\ncomplainant.  Not only that but the applicant  threatened the shop
\nowner of the dire consequences and to close down his business.  The
\nsaid incident was witnessed by neighbouring shop owners and other
\nsellers of firecrackers and thereafter, a written application against
\nthe applicant was given to the Mamlatdar.  Upon investigation, charge
\nsheet came to be filed on 4.1.2010 for the offences as above and the
\napplicant is shown as accused in the charge sheet No.001\/2010.\n<\/p>\n
3.\tLearned
\nadvocate for the applicant submits that complainant-a shop owner and
\nother neighboring shop owners were selling firecrackers during season
\nof Diwali and had no license and, therefore, the aplicant being a
\nfreelance journalist was performing his duty to report such illegal
\nactivities of the complainant and at no point of time the applicant
\ndemanded any amount.  It is the case of the applicant that the
\napplicant tried to expose illegal activities of the shop owners and
\nsome personnels from the Mamlatdar office and other such Government
\noffices, the applicant is being victimised.  Learned advocate for the
\napplicant further submits that if the powers under Section 482 of the
\ncode is not exercised, applicant who is performing his duty as a
\njournalist will be subjected to undue agony of the trial
\nparticularly, when no ingredients of offences are disclosed.  In
\naddition to above, it is submitted that in identical case, this Court
\nquashed and set aside similar F.I.R. and the said order is produced
\nat Annexure ‘C’ to this petition and is relied on by learned advocate
\nfor the applicant.\n<\/p>\n
4.\tHaving
\nheard learned advocates appearing for the parties, I am of the
\nopinion that allegations against the applicant are to the extent that
\nthe applicant has impersonated himself as an employee of the
\nMamlatdar Officer, Jetpur and projected himself as a Government
\nemployee.  Not only that but further allegations are to the extent
\nthat the amount demanded by the applicant is not paid, he would take
\nappropriate action against the shop owners and will close down their
\nbusiness.  This incident was witnessed by the neighbouring shop
\nowners and, therefore, they filed a representation before the office
\nof the Mamlatdar.  On completion of investigation, the charge sheet
\nis filed and prima facie a case is made out for the offence under
\nSections 384, 506 and 511 of the Indian Penal Code.  If the
\ndefinition of the above offences is seen, the allegations levelled in
\nthis complaint attract the ingredients of the sections.  Not only
\nthat the applicant who has done video-shooting, impersonated and
\nprojected himself as an Government employee of Mamlatdar Officer and
\nfurther threatened the shop owners for taking serious action for
\nselling firecrackers on foot path without license and to close down
\ntheir business cannot be said to be part of his duty.\n<\/p>\n
5.\tBe
\nthat as it may be.  Charges found in the police report under Section
\n173(2) of the Code, against the applicant are of such a nature which
\ndo not befit a noble profession like journalism, this Court is not
\noblivious of the fact that right to freedom guaranteed to the citizen
\nof India is subjected to reasonable restrictions and in the guise of
\nfreedom of speech, expression etc., the freedom and liberty given to
\na reporter\/journalist,  cannot be misused.\n<\/p>\n
6.\tIn
\nview of the above, I am not inclined to entertain this application.
\nThe prayers made in this application cannot be granted.  Criminal
\nMisc. Application is rejected.\n<\/p>\n
