The Child Development Project Officer, Mohania, Distt.- Kaimur\n         At Bhabua\n                                             -----------\n<\/pre>\n<p>3.   03.11.2011             Heard learned counsel for the petitioner<\/p>\n<p>                  and the State.\n<\/p>\n<p>                            This writ application was filed on 5.7.2010<\/p>\n<p>                  after serving two copies in the office of the Advocate<\/p>\n<p>                  General in accordance with the High Court rules.<\/p>\n<p>                  The second copy was          meant   to facilitate the<\/p>\n<p>                  expeditious filing of counter affidavit for disposal of<\/p>\n<p>                  the matter. On 01.04.2011 adjournment was granted<\/p>\n<p>                  to file counter affidavit.   No counter affidavit has<\/p>\n<p>                  been filed.\n<\/p>\n<p>                            The petitioner, an Anganwari Sewika is<\/p>\n<p>                  aggrieved by the order dated 16.3.2010 of the<\/p>\n<p>                  Director, I.C.D.S reinstating her in service but<\/p>\n<p>                  declining to grant honorarium.\n<\/p>\n<p>                            It is submitted that the petitioner came to<\/p>\n<p>                  this Court earlier in C.W.J.C. No. 7913 of 2008<\/p>\n<p>                  questioning her removal from the post of Anganwari<\/p>\n<p>                  Sewika of Akorhi Centre (Centre No. 26) ignoring the<br \/>\n<span class=\"hidden_text\">                        2<\/span><\/p>\n<p>report of the District Magistrate dated 25.11.2008 in<\/p>\n<p>her favour. The Court directed the Director, I.C.D.S.<\/p>\n<p>to examine her grievances. Relying upon the report<\/p>\n<p>dated 25.11.2008 it is submitted that there were no<\/p>\n<p>allegations with regard to closure of the Centre and<\/p>\n<p>consequent non working by the petitioner but only<\/p>\n<p>alleged irregularity for distribution subsequently<\/p>\n<p>found to be incorrect.\n<\/p>\n<p>            Counsel for the State submitted that if the<\/p>\n<p>petitioner has not worked in between the termination<\/p>\n<p>and reinstatement she is not entitled to honorarium<\/p>\n<p>on the principles of no work no pay.\n<\/p>\n<p>            There can be no quarrel with the very<\/p>\n<p>broad proposition that if the petitioner did not<\/p>\n<p>discharge duties in the interregnum she may not be<\/p>\n<p>entitled to honorarium. But if it is found that the<\/p>\n<p>termination itself was improper based on the enquiry<\/p>\n<p>report of the respondents themselves, can the<\/p>\n<p>liability   for   this      wrongful   termination    be    also<\/p>\n<p>fastened upon the petitioner.               The Court finds it<\/p>\n<p>difficult to hold that the respondents are entitled to<\/p>\n<p>the benefit of their own wrong order of termination.<\/p>\n<p>The    report     of       the   District   Magistrate     dated<\/p>\n<p>25.11.2008 makes it abundantly clear that the<\/p>\n<p>petitioner was working as an Anganwari Sewika<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>           throughout distributing ration. The allegations had<\/p>\n<p>           been made under a misconception.\n<\/p>\n<p>                       It is unfortunate that the impugned order<\/p>\n<p>           dated 16.3.2010 cautions the petitioner when there<\/p>\n<p>           was no occasion for the same in view of the report of<\/p>\n<p>           the District Magistrate dated 25.11.2008 finding no<\/p>\n<p>           fault with her.    Needless to state that any future<\/p>\n<p>           dereliction of duty is an entirely different matter.<\/p>\n<p>                       The petitioner is not a government servant<\/p>\n<p>           claiming back wages.      The principles applicable to<\/p>\n<p>           the same shall not appropriately govern the present<\/p>\n<p>           matter.\n<\/p>\n<p>                       The order dated 16.3.2010 is set aside to<\/p>\n<p>           the extent that it denies honorarium to the petitioner<\/p>\n<p>           for   the      period   between     termination        and<\/p>\n<p>           reinstatement.     Let the arrears of honorarium be<\/p>\n<p>           paid to the petitioner within a maximum period of<\/p>\n<p>           eight weeks from the date of receipt\/production of a<\/p>\n<p>           copy of this order before the concerned respondents.<\/p>\n<p>                       The writ application stands allowed.<\/p>\n<pre>P.
