No.237\/2010 with Nadiad Town Police Station, Nadiad for the<br \/>\n\toffences punishable under Section 379 of the Indian Penal Code.\n<\/p>\n<p>Learned<br \/>\n\tCounsel appearing for the applicants submitted that<br \/>\n\tthrough the allegation against the applicants is that they have<br \/>\n\tstolen the car of the complaint, the possession of the car has not<br \/>\n\tbeen recovered from the applicants and that therefore, by imposing<br \/>\n\tsuitable conditions, the applicants may be enlarged on bail.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP Mr. L.B.Dabhi for the respondent-State.\n<\/p>\n<p>Having<br \/>\n\theard learned Counsels for the parties and perusing the record of<br \/>\n\tthe case and taking into consideration the facts of the case, nature<br \/>\n\tof allegations, role attributed to the applicants, I deem it just<br \/>\n\tand proper to enlarge the applicants on bail by imposing suitable<br \/>\n\tconditions.\n<\/p>\n<p>Learned<br \/>\n\tCounsels for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicants are ordered to be released on bail in connection<br \/>\n\twith First Information Report registered as I-C.R. No.237\/2010 with<br \/>\n\tNadiad Town Police Station, Nadiad, on executing a bond of<br \/>\n\tRs.10,000\/- (Rupees Ten Thousand Only) with one surety of the like<br \/>\n\tamount to the satisfaction of the Trial Court and subject to the<br \/>\n\tconditions that they shall;\n<\/p>\n<p>a)<br \/>\n\t\tnot take undue advantage of liberty or misuse liberty;\n<\/p>\n<p>b)<br \/>\n\t\tnot act in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>c)<br \/>\n\t\tsurrender passport, if any, to the lower court within a week;\n<\/p>\n<p>d)<br \/>\n\t\tnot leave the State of Gujarat without prior permission of the<br \/>\n\tSessions Judge concerned;\n<\/p>\n<p>e)\tmark<br \/>\n\ttheir presence at the concerned Police Station first on 17th<br \/>\n\tMay, 2011 and thereafter on first and fifteen day of every month<br \/>\n\tbetween 11.00 a.m. and 2.00 p.m. <\/p>\n<p>f)<br \/>\n\t\tfurnish the present address of their residence to the Investigating<br \/>\n\tOfficer and also to the Court at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of this<br \/>\n\tCourt;\n<\/p>\n<p>g)<br \/>\n\t\tnot to enter within the Nadiad Taluka except, for the purpose of<br \/>\n\tattending the trial or marking presence.\n<\/p>\n<p>The<br \/>\n\tauthorities will release the applicants only if not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbond to be executed before the lower court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p>At<br \/>\n\tthe trial, the Trial Court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicants on bail.\n<\/p>\n<p>Rule<br \/>\n\tmade absolute.
