 S.B. Sinha, C.J.  <\/p>\n
 1. Whether an ‘Assistant Librarian’  working in the College of
\nArts is entitled to the same scale of pay paid to the
\n‘Assistant Librarian’  working in the Polytechnics is the
\nquestion involved in this writ petition.\n<\/p>\n
 2. The applicant was employed as ‘Assistant Librarian’ in the
\nCollege of Arts. The Human Resource Development of the
\nGovernment of India created various posts from time to time
\nin terms whereof posts of ‘Assistant Librarian’  had been
\nupgraded to the post of ‘Librarian’ and placed in higher scale
\nof pay. The petitioner prayed that he be placed in the scale
\nof pay of Rs. 1,400\/- — Rs. 2,600\/-.\n<\/p>\n
 3. It is not in dispute that the Fourth Central Pay Commission
\n(in short, ‘IV CPC’) did not consider the matter.\n<\/p>\n
 4. The learned Tribunal by reason of the impugned judgment
\ndeclined to grant any relief to the petitioner only on the
\nground that the fixation of pay-scale of ‘Assistant Librarians’
\nwould depend upon the size of library of the College of Arts
\nor in the Polytechnic.\n<\/p>\n
 The IV CPC in para 11.63 stated as under:-\n<\/p>\n
“11.63 There are difficulties in reclassifying
\nthe posts of librarians and
\nspecifying their qualifications and recruitment
\nlevels. The pay scales, qualifications and
\nrecruitment levels of responsibility will really
\ndepend on several factors, mainly on the size of
\nthe library, its character and importance. To
\ndraw up suitable proposals in this regard a
\ncommittee may be constituted to undertake
\nthis work. Pending such a review by the
\nCommittee, we recommend that librarians and
\nlibrary staff may be given the revised scales of
\npay proposed in Chapter 8.”\n<\/p>\n
 5. Mr. Venkataramani, the learned senior counsel appearing
\non behalf of the petitioner, submitted that the relevant
\ndocuments, although were directed to be produced, had not
\nbeen produced before the Tribunal.\n<\/p>\n
 6. The learned counsel for the petitioner contends that the said
\nfindings are wrong that the Report of the Committee had not
\nbeen produced.\n<\/p>\n
 7. The learned Tribunal in its impugned judgment held that
\nthe petitioner would be entitled to the scale of pay, as
\nrecommended by the Committee, which was constituted
\npursuant to the direction of the IV CPC.\n<\/p>\n
 8. From the Order Sheets dated 16.10.2000 and 30.10.2000
\npassed by the learned Tribunal and as contained in
\nAnnexure ‘P-16’ and ‘P-17’, it does not appear that the
\nrecommendations of the Committee constituted by the IV
\nCPC were produced before the learned Tribunal.\n<\/p>\n
 9. The applicant inter alia contended in the said original
\napplication by filing two Miscellaneous Applications that
\npursuant to the recommendations of the Committee, the
\nscales of pay had been revised as regard counterparts of the
\napplicants working in similar organisations.\n<\/p>\n

 11. It is not dispute that the principles of ‘equal pay for equal work’ in terms of Article 39(d) read with Article 14 of the
\nConstitution of India (in short, ‘the Constitution’) would be
\nattracted provided the concerned employees are similarly
\nsituated.\n<\/p>\n
 12. Furthermore, it appears that the learned Tribunal proceeded
\non the basis that the case for grant of the said scale of pay
\nwas not recommended by the IV CPC. However, in para 4(ii)
\nof their counter affidavit, it was stated as under:-\n<\/p>\n
  “4(ii) In reply to this para it is submitted that
\nthe applicant is a Graduate with Diploma in
\nLibrary Science. The post of Asstt. Librarian in
\nCollege of Arts was not dealt with by IIIrd Pay
\nCommission or by IVth Pay Commission and
\nhence, the applicant cannot claim the scale of
\nRs. 1400-2600 on the basis of recommendation
\nbecause replacement scale of Rs. 1200-2050
\nhas already been given as per recommendation
\nof the IIIrd Pay Commission.”\n<\/p>\n
 13. In that view of the matter, the learned Tribunal must be
\nheld to be wrong inasmuch as it proceeded on a wrong
\npremise, particularly in view of the fact that the petitioner in
\nhis reply to the preliminary objections categorically stated
\nthat the qualifications of ‘Assistant Librarian’  of the
\nPolytechnics as also the qualification of ‘Assistant Librarian’
\nin the College of Arts are similar.\n<\/p>\n
 14. It has further been stated that the petitioner had been
\nworking in the Library of Post-Graduate College, which has
\ninternational recognisition and is affiliated to the University of
\nDelhi. The said Library consists of thousands of rare books,
\nwhich are not only costly, but also technical in nature.\n<\/p>\n
 15. According to the petitioner, her duties and functions are
\nmuch arduous than the ‘Assistant Librarian’  of a
\nPolytechnic. Keeping in view the fact that the Report of the
\nCommittee had not been produced before the learned
\nTribunal and furthermore as admittedly the case of the
\npetitioner had not been considered either by the Third
\nCentral Pay Commission or the IV CPC, we are of the
\nopinion that the Tribunal committed a manifest error in
\ndismissing the said original application.\n<\/p>\n
 It may be that it could not have decided the matter itself,
\nbut, it ought to have drawn an adverse inference against the
\nrespondents herein for non-production of the Report of the
\nCommittee, which was constituted in terms of the directions
\nof the IV CPC. The Report of the Committee was very
\nrelevant. The respondents being a model employer could
\nnot have withheld the same.\n<\/p>\n
 16. In that view of the matter, we are of the opinion that the
\nimpugned judgment of the Tribunal cannot be sustained,
\nwhich is set aside accordingly. This writ petition is allowed.\n<\/p>\n
 17. The respondents are thereby directed to make the necessary
\njob of evaluation of the ‘Assistant Librarian’  in College of
\nArts vis-a-vis ‘Assistant Librarian’  in the Polytechnic and
\ntake an appropriate decision. Such decision must be taken
\nat an early date and not later than three months from the
\ndate of the communication of this order.\n<\/p>\n
 Keeping in view the fact that the respondent had not
\nproduced the relevant records before the Tribunal, we are of
\nthe opinion that the petitioner herein is also entitled to
\ncosts, which is quantified at Rs. 5,000\/-.\n<\/p>\n
