RESPONDENTS\n                               ****\n<\/pre>\n<p>\/4\/   28 February               Heard learned counsel for the petitioner<br \/>\n<span class=\"hidden_text\">      2011<\/span><br \/>\n                    and the learned counsel for the State.<\/p>\n<p>                                Petitioner is a convict, who wants a<\/p>\n<p>                    direction from this Court to the State authorities to<\/p>\n<p>                    consider granting him remission in respect of<\/p>\n<p>                    imprisonment for life awarded for offence under<\/p>\n<p>                    Sections 302 and 376 of the Indian Penal Code.<\/p>\n<p>                                In paragraph 16 of the writ petition a false<\/p>\n<p>                    statement has been made that the petitioner has not<\/p>\n<p>                    moved before this Hon&#8217;ble Court earlier in the instant<\/p>\n<p>                    matter.   The writ petition is supported by affidavit<\/p>\n<p>                    sworn by wife of the petitioner.\n<\/p>\n<p><span class=\"hidden_text\">                   2<\/span><\/p>\n<p>             The counter affidavit filed on behalf of the<\/p>\n<p>respondents no. 3 and 4 discloses the aforesaid<\/p>\n<p>misstatement of a material fact.       Copy of an order,<\/p>\n<p>dated 06.11.2009, passed by a Division Bench of this<\/p>\n<p>Court in Cr.W.J.C. No. 522 of 2009 has been annexed<\/p>\n<p>as Annexure &#8220;A&#8221; to support the fact stated in the<\/p>\n<p>counter affidavit that similar claim of the petitioner was<\/p>\n<p>rejected on merits and such a fact has been suppressed<\/p>\n<p>in the writ petition.\n<\/p>\n<p>             Learned counsel for the petitioner wanted<\/p>\n<p>to show that on merits the earlier Division Bench order<\/p>\n<p>is not in accordance with law subsequently clarified by<\/p>\n<p>the Supreme Court.\n<\/p>\n<p>             However, in view of the fact, noticed<\/p>\n<p>above, we are of the considered view that the attempt<\/p>\n<p>of the petitioner to suppress the material fact while<\/p>\n<p>invoking    writ jurisdiction of this Court has to be<\/p>\n<p>deprecated and in view of such conduct the petitioner<\/p>\n<p>has disentitled himself to any relief in the present<\/p>\n<p>proceeding. We are, further, of the considered view<\/p>\n<p>that it is not open for us to sit in appeal over the earlier<\/p>\n<p>Division Bench judgment, contained in Annexure &#8220;A&#8221;.<br \/>\n<span class=\"hidden_text\">                         3<\/span><\/p>\n<p>                   For the aforesaid reasons, the writ petition<\/p>\n<p>       is dismissed.\n<\/p>\n<p>                   We have not taken any action against the<\/p>\n<p>       petitioner or his wife because petitioner is already in<\/p>\n<p>       jail custody and the wife, in the facts of the case,<\/p>\n<p>       deserves to be given benefit of doubt that she might not<\/p>\n<p>       have been aware of the law and might be acting under<\/p>\n<p>       the dictates of her husband.\n<\/p>\n<\/p>\n<p>                               (Shiva Kirti Singh, J.)<\/p>\n<p>                              ( Gopal Prasad, J.)<br \/>\nS.A.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Surendra Prasad vs The State Of Bihar And Ors. on 28 February, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CR.W.J.C.
