The writ court considered the impugned<\/p>\n<p>                      order of the District Magistrate, Purnia passed on the<\/p>\n<p>                      orders and directions of this court in an earlier writ<\/p>\n<p>                      petition and has found no good material to interfere<\/p>\n<p>                      with the views expressed by the District Magistrate<\/p>\n<p>                      after proper enquiry that appellant&#8217;s appointment was<\/p>\n<p>                      by manipulation and another candidate having better<\/p>\n<p>                      marks and above her in the panel ought to have been<\/p>\n<p>                      appointed.\n<\/p>\n<p><span class=\"hidden_text\">                             2<\/span><\/p>\n<p>                    In the facts of the case, we find no good<\/p>\n<p>        reasons to interfere with the order of the writ court on<\/p>\n<p>        merit. However, it appears that the District Magistrate<\/p>\n<p>        has also directed for recovery of salary paid to the<\/p>\n<p>        appellant for the period she was working on the post of<\/p>\n<p>        Shiksha Mitra. Since the post of Shiksha Mitra was, at<\/p>\n<p>        the relevant time, filled up only on contractual basis<\/p>\n<p>        and the appellant worked on account of orders issued<\/p>\n<p>        by the Mukhiya and other competent authorities, in our<\/p>\n<p>        view,     equity   does   not   warrant   realization   of<\/p>\n<p>        honorarium already paid to her for her work. Only to<\/p>\n<p>        that extent, the order of the District Magistrate dated<\/p>\n<p>        9-5-2008 is modified.
