(Oral)\n<\/pre>\n<p>            This revision petition is directed against the order passed by the<\/p>\n<p>learned Motor Accident Claims Tribunal, Sonepat (for short the Tribunal)<\/p>\n<p>vide which application moved by the petitioner\/claimant for amendment of<\/p>\n<p>claim petition was ordered to be dismissed.\n<\/p>\n<p><span class=\"hidden_text\"> CR No.6465 of 2007                                              2<\/span><\/p>\n<p>            The petitioner filed a claim petition on 24.9.2004 claiming<\/p>\n<p>compensation on account of injuries suffered by the petitioner in a motor<\/p>\n<p>vehicular accident which took place on 10.6.2004. The case set up by the<\/p>\n<p>petitioner was that    offending vehicle was       TATA Sumo         bearing<\/p>\n<p>registration No.HR-15B-3938. Same number was pleaded in the petition.<\/p>\n<p>            Written statement was filed. Thereafter parties led evidence<\/p>\n<p>wherein vehicle number was again given as HR-15-B-3938. It was pleaded<\/p>\n<p>by the petitioner that actual registration number of he vehicle was HR-15-<\/p>\n<p>3938 and amendment was sought to correct the typographical error. Copy<\/p>\n<p>of the challan was produced in support of amendment application, wherein<\/p>\n<p>number of vehicle was shown different on different places. At some places<\/p>\n<p>number of vehicle was shown to be HR 15B-3938, whereas at some other<\/p>\n<p>places it was shown as HR-15-3938.\n<\/p>\n<p>            The contention of the petitioner was that it was due to this that<\/p>\n<p>wrong number was mentioned. It was alleged that vide recovery memo the<\/p>\n<p>police had taken into possession vehicle bearing registration No.HR-15-<\/p>\n<p>3938.\n<\/p>\n<p>            The application was contested primarily on the plea that<\/p>\n<p>mechanical examination of vehicle HR-15B-3938           was conducted and<\/p>\n<p>therefore, the petitioner could not be allowed to amend the petition at this<\/p>\n<p>belated stage. The plea was accepted by the learned Tribunal.<\/p>\n<p>            On consideration of the matter, I find that the impugned order<\/p>\n<p>cannot be sustained. Once it was not disputed that in the recovery memo the<\/p>\n<p>police had taken vehicle No.HR-15-3938 in custody. Thus, there was no<br \/>\n<span class=\"hidden_text\"> CR No.6465 of 2007                                            3<\/span><\/p>\n<p>occasion whatsoever, to mechanically examine vehicle No.HR-15B-3938.<\/p>\n<p>Description of the vehicle and the make given in the petition tally with the<\/p>\n<p>vehicle bearing No.HR-15-3938.\n<\/p>\n<p>               It may also be noticed here that vehicle No.HR-15-3938 stood<\/p>\n<p>insured with the Insurance Company and therefore, there is hardly any<\/p>\n<p>reason for the Insurance Company to contest the claim petition if vehicle<\/p>\n<p>number was not No.HR-15-3938.\n<\/p>\n<p>               The amendment sought, therefore, was      merely to correct,<\/p>\n<p>typographical error, and was otherwise, necessary for the adjudication of<\/p>\n<p>the dispute.\n<\/p>\n<p>               The revision petition is allowed.
