                 IN THE HIGH COURT OF JUDICATURE AT PATNA\n                        Cr.Misc. No.15103 of 2010\n           1. MD.MOHSIN, son of Md. Mahboob\n           2. Md. Mukhatar, son of late Md. Rasid\n              Both resident of village Hare Rampur, P.S.\n              Baisi, District Purnia\n                                  Versus\n                              STATE OF BIHAR\n                               -----------\n<\/pre>\n
3.   12.10.2010          Having   heard    counsel  for   the<\/p>\n
                petitioners and the counsel for the State as<\/p>\n
                also taking into account the report of the<\/p>\n
                trial court at Flag ‘A’ stating that the<\/p>\n
                trial of the petitioners is already under<\/p>\n
                progress     and     four    witnesses      have    already<\/p>\n
                been examined, this Court is not inclined to<\/p>\n
                grant      bail     to   the    petitioners        for   the<\/p>\n
                present,          inasmuch     as     now     only       the<\/p>\n
                Investigating Officer and the informant have<\/p>\n
                to be examined.\n<\/p>\n
                            Since the trial court has in the<\/p>\n
                report dated 7.9.2010 set out a time limit<\/p>\n
                of four months, this Court would expect the<\/p>\n
                trial court to adhere to the said time limit<\/p>\n
                and   to    that    extent     the   Superintendent       of<\/p>\n
                Police, Purnea is hereby directed to ensure<\/p>\n
                that the presence of both the informant and<\/p>\n
                the Investigating Officer is made available<\/p>\n
                to the court for concluding the trial in the<\/p>\n
                aforementioned period.\n<\/p>\n
                         2<\/span><\/p>\n
                     With       the         aforementioned<\/p>\n
            observation, this application is dismissed.<\/p>\n
