Director<br \/>\n                                              Directorate of Education<br \/>\n                                              District North West<br \/>\n                                              Office of the deputy directorate of education<br \/>\n                                              B.L Block Shalimar Bagh<br \/>\n                                              Delhi-110085<\/p>\n<p>RTI application filed on              :       07\/05\/2010<br \/>\nPIO replied                           :       09\/06\/2010<br \/>\nFirst appeal filed on                 :       14\/06\/2010<br \/>\nFirst Appellate Authority order       :       12\/07\/2010<br \/>\nSecond Appeal received on             :       08\/08\/2010<\/p>\n<p>Information sought<br \/>\nProvide the copy of the letter or the order D. no. 136 dated 03-06-2005 for declaration of H.O.S of Mr.<br \/>\nM.S Anand V.P G.M School , Shahabad Dairy , was sent to D.D.E (NW-A) through E.O zone -10.<br \/>\nWhether Mr. M.S Anand V.P was declared H.O.S from 25-05-2005 to 30-04-2006. If not give the<br \/>\nname of the H.O.S during 25-05-2005 to 30-04-2006 from the above mentioned school.\n<\/p>\n<p>Reply of the Public Information Officer<br \/>\nPIO had enclosed the reply as received from the schools and had stated that the letter is not traceable.\n<\/p>\n<p> Grounds for the First Appeal:\n<\/p>\n<p>Information denied to the appellant and is unsatisfactory.\n<\/p>\n<p>Order of the First Appellate Authority (FAA):<br \/>\nFAA was satisfied by the reply furnished by the PIO.\n<\/p>\n<p>Grounds for the Second Appeal:\n<\/p>\n<p>Unsatisfactory reply of the PIO and the FAA<\/p>\n<p>Relevant Facts emerging during Hearing:<br \/>\nThe following were present:\n<\/p>\n<p>Appellant: Mr. M.S Anand;\n<\/p>\n<p>Respondent: Ms. Neema Kumari, Public information officer &amp; Dy. Director;\n<\/p>\n<p>        The PIO has stated that the letter appointing the appellant as HOS is missing and inspite of best<br \/>\nefforts it has not been found. However, the PIO admits that the appellant was HOS during the period<br \/>\n25-05-2005 to 30-04-2006. In view of this the PIO states that she will give a letter to the effect that the<br \/>\noriginal appointment order cannot be found but the appellant was addressed to the period 25-05-2005<br \/>\nto 30-04-2006.\n<\/p>\n<p> Decision:\n<\/p>\n<p>The Appeal is allowed.\n<\/p>\n<p>      The PIO is directed to give the letter as directed above to the appellant before<br \/>\n05 October 2010.\n<\/p>\n<p>This decision is announced in open chamber.<br \/>\nNotice of this decision be given free of cost to the parties.<br \/>\nAny information in compliance with this Order will be provided free of cost as per Section 7(6) of RTI Act.\n<\/p>\n<p>                                                                                                                        Shailesh Gandhi<br \/>\n                                                                                                              Information Commissioner<br \/>\n                                                                                                                     27 September 2010<br \/>\n(For any further correspondence on this matter, please mention the file number quoted above.)
