Justice ANTONY DOMINIC\n\n Dated :15\/11\/2007\n\n O R D E R\n                   ANTONY DOMINIC, J.\n\n            = = = = = = = = = = = = = = = =\n              W.P.(C) No. 30332 OF 2007 J\n            = = = = = = = = = = = = = = = =\n\n           Dated this the 15th November, 2007\n\n                    J U D G M E N T\n<\/pre>\n<p>    On the basis of penalty that was imposed on the<\/p>\n<p>petitioner  Ext. P1 notice was issued.     Aggrieved by<\/p>\n<p>this, a revision was filed  before the Commissioner for<\/p>\n<p>Commercial Taxes, who disposed of the matter by Ext. P7<\/p>\n<p>order.  By this order the Commissioner held that the<\/p>\n<p>matter needs re-examination.   Accordingly, the case is<\/p>\n<p>remitted back to the 1st respondent for de novo disposal<\/p>\n<p>within 3 months.  It was made clear in the said order<\/p>\n<p>that in case the petitioner fails to produce the books<\/p>\n<p>of account and connected evidence for 2003-04 before<\/p>\n<p>the 1st respondent within 15 days of receipt of that<\/p>\n<p>order, the order of penalty will stand revived.<\/p>\n<p>    2. It is submitted that Ext. P7 order was received<\/p>\n<p>by  the   petitioner   on   4-6-2007   and   immediately<\/p>\n<p>thereafter  by  Ext.   P8   the  petitioner  sought   an<\/p>\n<p><span class=\"hidden_text\">WPC No. 30332\/07             -2-<\/span><\/p>\n<p>appointment with the 1st respondent for producing the<\/p>\n<p>books of accounts as ordered in Ext. P7.    According to<\/p>\n<p>the 1st respondent, the request was made beyond the time<\/p>\n<p>specified in Ext. P7 and on that basis the records were<\/p>\n<p>not accepted.       It is also submitted that in the<\/p>\n<p>meanwhile by Ext. P4 assessment was completed based on<\/p>\n<p>the  penalty     order  against  which appeal  and  stay<\/p>\n<p>petition were also filed before the 2nd respondent and<\/p>\n<p>they were also pending.      Despite the pendency of the<\/p>\n<p>appeal, when revenue recovery steps were initiated by<\/p>\n<p>Ext. P9 this writ petition is filed.\n<\/p>\n<p>    3. Now that by Ext. P7 the matter was remanded to<\/p>\n<p>the 1st respondent, petitioner requested by Ext. P8 for<\/p>\n<p>an opportunity and that is within the time specified in<\/p>\n<p>Ext. P7.       Although this is disputed by the learned<\/p>\n<p>Govt. Pleader, there is no material to discredit Ext.<\/p>\n<p>P8.   Hence, I feel interest of justice requires that<\/p>\n<p>the  petitioner     should be   given an opportunity  to<\/p>\n<p>produce the books of account as was permitted by the<\/p>\n<p>Commissioner of Commercial Taxes in Ext. P7 order.<\/p>\n<p>Accordingly, I dispose of this writ petition with the<\/p>\n<p>following directions:\n<\/p>\n<p><span class=\"hidden_text\">WPC No. 30332\/07           -3-<\/span><\/p>\n<p>    That the petitioner shall appear before the 1st<\/p>\n<p>respondent on 30-11-2007 with all documents which he<\/p>\n<p>intends to produce and the 1st respondent shall complete<\/p>\n<p>the enquiry as ordered in Ext. P7.   Since the order to<\/p>\n<p>be passed will have a bearing on Ext. P5 appeal against<\/p>\n<p>Ext. P4, until orders are passed as above, all further<\/p>\n<p>proceedings pursuant to Ext.
