It is not in dispute that there was<br \/>\npartnership deed executed between the petitioners and the respondents<br \/>\non 1.1.1989. In course of this partnership business, dispute arose<br \/>\nbetween the partners. The petitioners, therefore, issued notice dated<br \/>\n27.12.2010 indicating that they resort to arbitration to resolve such<br \/>\ndisputes. Respondents replied to the notice vide communication dated<br \/>\n5.1.2011. They however, did not agree to appointment of arbitrator.<br \/>\nPresent petition is therefore, filed by the petitioners seeking<br \/>\nappointment of arbitrator.\n<\/p>\n<p>\tCounsel<br \/>\nfor the respondent, however, submitted that the claim is belated.<br \/>\nArbitrator, therefore, may not be appointed.\n<\/p>\n<p>\tIt<br \/>\nis not in dispute that partnership deed contains arbitration clause.<br \/>\nThe question of limitation can also be gone into by the Arbitrator<br \/>\nwhile taking up the arbitration proceedings. Under the circumstances,<br \/>\nJustice C.K. Buch (Retd.) is requested to act as sole arbitrator to<br \/>\nresolve the disputes arising out of agreement dated 1.1.1989.
