PUBLIC PROSECUTOR for\nRespondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.B.PARDIWALA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 11\/05\/2011  \n \nORAL ORDER<\/pre>\n<p>\tRule.\n<\/p>\n<p>Learned APP, Mr Kodekar, waives service of notice of rule for and on<br \/>\nbehalf of State.\n<\/p>\n<p>2.\tThis<br \/>\nis an application under Section 439 of Criminal Procedure Code<br \/>\npraying for regular bail in connection with offence registered with<br \/>\nVadali Police Station, vide C.R.No.I-55 of 2010  for the offences<br \/>\npunishable under Sections 363, 366, 504, 506(2) read with 114 of IPC<br \/>\nand subsequently Section 376 came to be added.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned advocate Mr Raval for the applicant-accused and Mr Kodekar,<br \/>\nlearned APP for the State. At the request of the learned advocates<br \/>\nfor the parties, reasoned order is not passed.\n<\/p>\n<p>4.\tConsidering<br \/>\nnature of the offence, the role ascribed to the accused-applicants<br \/>\nand other relevant aspects,  I am persuaded to exercise my<br \/>\ndiscretion in favour of the applicant-accused taking into<br \/>\nconsideration the following aspects :-\n<\/p>\n<p><span class=\"hidden_text\">(1)<\/span><\/p>\n<p>The accused-applicants are not the principal accused persons.\n<\/p>\n<p>(2)\tInvestigation<br \/>\nis over and chargesheet is filed;\n<\/p>\n<p>(3)\tThe<br \/>\naccused-applicants have no criminal antecedents;\n<\/p>\n<p><span class=\"hidden_text\">(4)\t<\/span><\/p>\n<p>It is not even the case of the prosecution that they have committed<br \/>\noffence under Section 376;\n<\/p>\n<p>(5)\tIdentically<br \/>\nsituated other co-accused have been ordered to be released on regular<br \/>\nbail vide order dated 15.4.2011 passed in Criminal Misc. Application<br \/>\nNo.4161 of 2011.\n<\/p>\n<p>5.\tIn<br \/>\nthis view of the matter, the accused-applicants are ordered to be<br \/>\nreleased on bail<br \/>\nin connection C.R. No.I-55 of 2010 registered with Vadali Police<br \/>\nStation,  on their executing a bond in the sum of Rs.15,000\/- (Rupees<br \/>\nfifteen thousand only) each with one solvent surety each of the like<br \/>\namount to the satisfaction of the lower Court and subject to the<br \/>\nconditions that they shall,<\/p>\n<p>not<br \/>\n\ttake undue advantage of their liberty or abuse their liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>maintain<br \/>\n\tlaw and order;\n<\/p>\n<p>mark<br \/>\n\ttheir presence before Vadali Police Station on every 1st<br \/>\n\tand 15th day of English Calendar month between 11:00 am<br \/>\n\tto 2:00 pm:\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>furnish<br \/>\n\tthe addresses of their residence at the time of execution of the<br \/>\n\tbond and shall not change the residence without prior permission of<br \/>\n\tthis Court;\n<\/p>\n<p>surrender<br \/>\n\ttheir passport, if any, to the Lower Court immediately.\n<\/p>\n<p>6.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>7.\tBail<br \/>\nbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>8.\tRule<br \/>\nis made absolute.
