KRISHNAN, J.\n\n\n\n                = = = = = = = = = = = = = = =\n\n                W.P.(C)  No. 10790 OF 2007 h\n\n                = = = = = = = = = = = = = = =\n\n\n\n                 Dated this the 31st May, 2007\n\n\n\n                         J U D G M E N T\n<\/pre>\n<p>     This   writ   petition   is   filed   challenging   the   order<\/p>\n<p>passed   by   the   Land   Tribunal   as   Ext.   P3   in   a   suit<\/p>\n<p>pending   before   the   Munsiff&#8217;s   Court,   Nadapuram.             A<\/p>\n<p>question   of   tenancy   arose   and   the   matter   was   referred<\/p>\n<p>to   the   Land   Tribunal   for   adjudication   on   the   question<\/p>\n<p>of tenancy.   It was numbered as Referred Case No. 9 of<\/p>\n<p>2003   by   the   Land   Tribunal   and   it   had   entered   into   a<\/p>\n<p>finding that defendants 1, 3 and 4 are entitled to have<\/p>\n<p>fixity of tenure in relation to the property.   Section<\/p>\n<p>125   of   the   Kerala   Land   Reforms   Act   deals   with   the<\/p>\n<p>reference.     Under   Section   125(4),   the   Land   Tribunal<\/p>\n<p>shall   decide   the   question   referred   to   it   under   sub-\n<\/p>\n<p>section   (3)   and   return   the   records   together   with   its<\/p>\n<p>decision   to   the   civil   court.     The   civil   court   shall<\/p>\n<p>then   proceed   to   decide   the   suit   or   other   proceedings<\/p>\n<p>accepting   the   decision   of   the   Land   Tribunal   on   the<\/p>\n<p>question   referred   to   it.     The   decision   of   the   Land<\/p>\n<p><span class=\"hidden_text\">WPC No. 10790\/2007                -2-<\/span><\/p>\n<p>Tribunal on the question referred to it shall, for the<\/p>\n<p>purpose of appeal, be deemed to be  part of the finding<\/p>\n<p>of   the   civil   court.     So,   the   order   passed   by   the<\/p>\n<p>Tribunal   on   reference   is   finding   on   an   issue   which<\/p>\n<p>becomes   part   and   parcel   of   a   civil   court   judgment   and<\/p>\n<p>therefore   the   order   under   reference   cannot   be<\/p>\n<p>challenged   directly   before   any   authority,   but   it   shall<\/p>\n<p>be   only   challenged   in   appeal   when   an   appeal   is<\/p>\n<p>preferred   against  the  judgment  and  decree  of  the  civil<\/p>\n<p>court.   A Division Bench of this Court in the decision<\/p>\n<p>reported   in  Mohammed   v.   Musthaffa  (1978   KLT   168)   has<\/p>\n<p>held that &#8220;No writ petition in the matter would lie at<\/p>\n<p>this stage in view of the fact that the decision of the<\/p>\n<p>Land   Tribunal   will   form   part   of   the   findings   of   the<\/p>\n<p>Munsiff&#8217;s   Court  in  its  judgment  in  the  original  suit.&#8221;\n<\/p>\n<p>This   Court   also   had   held   that   no   revision   will   lie<\/p>\n<p>against   a   finding   recorded   by   the   Land   Tribunal   on   a<\/p>\n<p>reference   made   by   Civil   Court   u\/s.   125(3)   of   <a href=\"\/doc\/1689905\/\">Land<\/p>\n<p>Reforms   Act   (Kallianikutty   Amma   v.   Govindan   Nair<\/a>  (1981<\/p>\n<p>KLT   560).     So   these   decisions   clearly   lay   down   the<\/p>\n<p>position of law.\n<\/p>\n<p><span class=\"hidden_text\">WPC No. 10790\/2007               -3-<\/span><\/p>\n<p>        Therefore,   this   writ   petition   lacks   merits   and<\/p>\n<p>therefore is dismissed.\n<\/p>\n<p>                                                M.N.
