3\/   23\/06\/2011             Heard learned counsel for the petitioner and<\/p>\n
                  learned counsel for the State.\n<\/p>\n
                            The petitioner who is the Secretary of the<\/p>\n
                  Managing    Committee,    Tilka   Manjhi   Kanya   Uchch<\/p>\n
                  Vidyalaya, Bhagalpur, is aggrieved by the order dated<\/p>\n
                  23.6.2008 passed by the Deputy Directory, Secondary<\/p>\n
                  Education, declining grant of recognition on the ground<\/p>\n
                  that the educational institution      did not fulfil the<\/p>\n
                  prescribed mandate with regard to land and building.<\/p>\n
                            Learned counsel for the petitioner submits<\/p>\n
                  that the school was inspected earlier on 10.9.1996 and<\/p>\n
                  found to possess land and building fulfilling conditions<\/p>\n
                  of recognition.\n<\/p>\n
                            The respondents in the counter affidavit<\/p>\n
                  contended that the District Education Officer was<\/p>\n
                  requested on 22.6.2006 to send necessary report after<\/p>\n
                  conducting spot inspection of the school. A report dated<\/p>\n
                  31.1.2007 was received and was then considered on the<\/p>\n
                  issue of recognition which has been rejected by the<\/p>\n
                  order dated 28.12.2007.\n<\/p>\n
                      2<\/span><\/p>\n
          This     Court       on   19.4.2011     required   the<\/p>\n
respondents to bring on record the inspection report<\/p>\n
dated 31.1.2007.\n<\/p>\n
          Learned counsel for the State has produced a<\/p>\n
Xerox copy of the report dated 31.12.2007. Correctly<\/p>\n
speaking, it should have been placed on record by way<\/p>\n
of an affidavit. The order produced is directed to be kept<\/p>\n
on record. The inspection report states that the<\/p>\n
institution had lands available. It also mentions with<\/p>\n
regard to the availability of building at column-4. It is<\/p>\n
therefore manifest that it is not a case where barren<\/p>\n
lands were claimed to be a school. The authorities in<\/p>\n
their inspection dated 31.1.2007 did find that the<\/p>\n
institution    was       in    possession    of    lands     and<\/p>\n
constructions stood thereupon details whereof are<\/p>\n
mentioned in the inspection report. Contrary to the<\/p>\n
same the impugned order is vague and hardly helpful in<\/p>\n
adjudication. Little did the respondents realize that if<\/p>\n
their order was subject to challenge by the aggrieved<\/p>\n
before a competent forum, their order was required to<\/p>\n
be reasoned and discussed. The requirement of the law<\/p>\n
not complied was a necessity to be mentioned in the<\/p>\n
impugned order in comparison to what was found on<\/p>\n
the site during inspection to arrive at the conclusion<\/p>\n
how   and     in   what       manner   the   requirements    for
\n                        3<\/span><\/p>\n
     recognition were not fulfilled.\n<\/p>\n
               The order dated 23.6.2008 is set aside. An<\/p>\n
     inspection is already stated to have been held on<\/p>\n
     31.1.2007 and a report is available. All that is now<\/p>\n
     required is to pass a fresh, reasoned and speaking order<\/p>\n
     so that litigation is brought to an end and not<\/p>\n
     continued by the respondents by passing orders which<\/p>\n
     are inconclusive in nature and not specific. The Deputy<\/p>\n
     Director, Primary, Secondary and Adult Education shall<\/p>\n
     ensure that the authorities pass a reasoned and<\/p>\n
     speaking order on the issue of recognition within a<\/p>\n
     maximum period of two months from the date of<\/p>\n
     receipt\/production of a copy of this order before him.<\/p>\n
               The application stands allowed, but only to<\/p>\n
     the extent indicated.\n<\/p>\n<\/p>\n
