14\/   06.08.2010           Heard learned counsel for both the parties.<\/p>\n
                           This miscellaneous appeal is directed against the<\/p>\n
                   order dated 16.02.2000 passed by the Deputy Labour<\/p>\n
                   Commissioner     –   Cum     –   Workmen      Compensation<\/p>\n
                   Commissioner, Magadh Division, Gaya by which he has<\/p>\n
                   granted compensation of Rs.2,24,000\/- to the respondents<\/p>\n
                   who is the heir of the deceased Ramesh Kumar claims to be<\/p>\n
                   the driver on the bus bearing no. BR 25\/8599. The accident<\/p>\n
                   alleged to be taken place on 29.10.1998. However, the claim<\/p>\n
                   petition has been filed on 1999 with a petition for condoning<\/p>\n
                   the delay claiming that the claimant is the brother of the<\/p>\n
                   deceased who was minor on the date of occurrence<\/p>\n
                   dependent on the deceased as the father and mother of the<\/p>\n
                   deceased has already expired and even a petition for
\n                    -2-<\/span><\/p>\n
condoning the delay filed along with the petition.<\/p>\n
        Learned counsel for the appellant, however,<\/p>\n
contended that the Deputy Labour Commissioner-cum-<\/p>\n
Workmen Compensation Commissioner, Magadh Division,<\/p>\n
Gaya has no jurisdiction as Gaya, Jehanabad, Aurangabad,<\/p>\n
Bhabhua and Ramgardh come under the jurisdiction of<\/p>\n
Presiding Officer, Labour Court, Dalmiannagar.<\/p>\n
        Learned    counsel     for   the   appellant,   further<\/p>\n
contended that the limitation petition was not allowed. The<\/p>\n
claimant has not established the age of the deceased victim<\/p>\n
or he was a workman died during the service and hence the<\/p>\n
entire evidence about the claim is vague and has not<\/p>\n
discharged the onus to prove the case by cogent and reliable<\/p>\n
evidence and even on preponderance of probability as<\/p>\n
witnesses are untrustworthy and brother of deceased has not<\/p>\n
been examined. Further the Evidence Act or burden of proof<\/p>\n
on the preponderance of probability has not been established<\/p>\n
as no document has been provided for the victim being of<\/p>\n
the age 20 years or that he was employed as workman and<\/p>\n
the brothers have not been examined and hence the<\/p>\n
witnesses are untrustworthy.\n<\/p>\n

        Learned counsel for the opposite party, however,<\/p>\n
contended that it was not within the competence of the<\/p>\n
appellant to produce the document. However, there is no<\/p>\n
challenge either by the owner or by the Insurance Company<\/p>\n
during the proceeding before the labour court and nothing<\/p>\n
has been brought in the notice either in the impugned order<\/p>\n
or in the grounds of appeal that there was any contest raised<\/p>\n
by the insurance company or the worker that the deceased<\/p>\n
was not a workman or the Tribunal had no territorial<\/p>\n
jurisdiction and others and further the claimant had filed a<\/p>\n
petition for limitation in the lower court and the court has<\/p>\n
taken note of that the Workmen Compensation Act is a<\/p>\n
beneficial legislation and hence there must have been a<\/p>\n
liberal construction in favour of the claimant and if the<\/p>\n
objection has not been raised by the appellant, the claim of<\/p>\n
the claimant was allowed.\n<\/p>\n
        However, from perusal of the orders it is the<\/p>\n
Deputy Labour Commissioner, Workmen Compensation<\/p>\n
Act, Magadh Division, Gaya has passed the order on<\/p>\n
16.02.2002. The notification suggest that all the Presiding<\/p>\n
Officer of the Labour Courts – cum – Workmen
\n                    -4-<\/span><\/p>\n
Compensation Commissioner can dispose of the claims if<\/p>\n
not contested and in the notification itself in Item No. 22<\/p>\n
mentions the Deputy Labour Commissioner, Magadh<\/p>\n
Division, Gaya has jurisdiction over the entire Magadh<\/p>\n
Division in the same notification which has been relied<\/p>\n
upon, a faded copy has been filed notification dated<\/p>\n
06.12.1995. Moreover in the grounds of appeal by the<\/p>\n
appellant there is no mention of any ground taken as such<\/p>\n
that the Deputy Labour Commissioner – cum – Workmen<\/p>\n
Compensation Commissioner, Magadh Division, Gaya has<\/p>\n
no jurisdiction to dispose of the claim under Workmen<\/p>\n
Compensation Act for the territorial jurisdiction of Gaya<\/p>\n
specifically. However, general grounds have been taken that<\/p>\n
the order is illegal without jurisdiction but it has not been<\/p>\n
specifically mentioned how it is without jurisdiction.<\/p>\n
        Learned counsel for the appellant, however,<\/p>\n
contended that the claim is barred by limitation. However,<\/p>\n
in the grounds of appeal there is no ground for limitation<\/p>\n
has been taken nor there is any mention about the basic facts<\/p>\n
for the limitation and the court has taken into consideration<\/p>\n
the fact that the claimant was 17 years at the time of the
\n                    -5-<\/span><\/p>\n
death of the deceased and was dependent on income of<\/p>\n
deceased and when the claimant got adult then has filed the<\/p>\n
case and even filed a separate petition for condoning the<\/p>\n
delay and after duly scrutinizing the claim petition the claim<\/p>\n
petition was registered and notices issued to the opposite<\/p>\n
party to deposit the claim or give a written statement and the<\/p>\n
copy of the same was also given to the appellant and the<\/p>\n
claim petition was heard on various dates and even the<\/p>\n
written statement filed by the Insurance Company and the<\/p>\n
certificate of the age and even the statement of witness<\/p>\n
Krishna Kumar and Bharat Prasad were recorded. The<\/p>\n
Tribunal on perusal of the First Information Report, post<\/p>\n
mortem, insurance policy and the statement of the witnesses<\/p>\n
held that the deceased was a driver at the time of the death<\/p>\n
and the claimant is the younger brother dependent on the<\/p>\n
income of the deceased and since the deceased was<\/p>\n
unmarried whose parents had died and under Section 2(D)<\/p>\n
of the Workmen Compensation Act the younger brother is a<\/p>\n
dependent and hence is liable to that compensation.<\/p>\n
        Learned counsel for the Insurance Company,<\/p>\n
however, contends that the claimant has not produced any
\n                    -6-<\/span><\/p>\n
document either to show that the deceased was a workman<\/p>\n
as he has not produced any paper. However, it is difficult for<\/p>\n
the claimant to procure any document from a private bus<\/p>\n
owner but neither the owner nor the insurance company has<\/p>\n
come forward to contest and dispute that the deceased was<\/p>\n
not a workman nor there is any contest or challenge that the<\/p>\n
deceased was not a brother of the driver and when these<\/p>\n
matter has not been disputed then disbelieving the evidence<\/p>\n
of the witnesses or disclaiming the claim of the claimant<\/p>\n
does not appear to be proper as Workmen Compensation<\/p>\n
Act is a beneficial legislation and the law is to be interpreted<\/p>\n
in liberal construction. The insurance company and the<\/p>\n
owner have been given the option to dispute and challenge<\/p>\n
the facts. However, there is nothing on record to suggest<\/p>\n
either in the grounds of appeal or by any document even by<\/p>\n
the written statement that they challenged that the deceased<\/p>\n
was not the workman or the claimant is not the brother.<\/p>\n
Since there was no challenge the Labour Commissioner has<\/p>\n
jurisdiction to decide. From the entire impugned order there<\/p>\n
is nothing to show that there was any contest.<\/p>\n
         Learned counsel for the appellant, however,
\n                   -7-<\/span><\/p>\n
contested that the Deputy Labour Commissioner, Magadh<\/p>\n
Division, Gaya has no jurisdiction because when there is a<\/p>\n
contest it is a Labour Court who has got jurisdiction.<\/p>\n
However, there is nothing on record to suggest that there<\/p>\n
was any contest or dispute raised that the deceased was not a<\/p>\n
workman or the claimant was not the heir or brother<\/p>\n
dependent on the deceased and hence since there is no<\/p>\n
dispute raised the Insurance Company cannot challenge<\/p>\n
even in the grounds of appeal no grounds has been taken<\/p>\n
that they have challenged these facts. However, the only<\/p>\n
points raised that the appellant has not produced any<\/p>\n
document regarding the facts that the deceased was the<\/p>\n
workman of the vehicle owned by the owner or the claimant<\/p>\n
has not proved by a document that he was dependent on his<\/p>\n
bother or about his age. However, the impugned order itself<\/p>\n
mentions that the deceased produced the school leaving<\/p>\n
certificate and adduce evidence the evidence of the witness<\/p>\n
to hold that the deceased was a workman and the claimant<\/p>\n
was the owner and it was incumbent on the insurance<\/p>\n
company to challenge the facts or to dispute the claim.<\/p>\n
However, it has been contended that the fact has not been
\n                             -8-<\/span><\/p>\n
         proved well within Section 101 and 102 of the Evidence<\/p>\n
         Act. However, the Evidence Act is not strictly applied in<\/p>\n
         such proceedings like the Motor Vehicles Act and the<\/p>\n
         Workmen Compensation Act and it is incumbent on the<\/p>\n
         Insurance Company or the worker to contest or dispute but<\/p>\n
         the insurance company could not show that labour disputed<\/p>\n
         or challenged the claim of the claimant and hence I do not<\/p>\n
         find any merit in this appeal, hence, the appeal is dismissed.<\/p>\n
