No. 2912 of 2010\n\n                          This    I.A.   has     been     filed     for\n\n<\/pre>\n<p>                 substituting the name of petitioner, who is<\/p>\n<p>                 said to have died on 26.12.2009, by her legal<\/p>\n<p>                 heirs   and   representatives   as     mentioned   in<\/p>\n<p>                 paragraph 4 of the I.A.\n<\/p>\n<p><span class=\"hidden_text\">                     2<\/span><\/p>\n<p>          There is no opposition to the I.A.<\/p>\n<p>          The I.A. is allowed. Let the name of<\/p>\n<p>petitioner be expunged from the cause title<\/p>\n<p>of the writ application and the names of her<\/p>\n<p>legal heirs and representative be substituted<\/p>\n<p>in place of petitioner.\n<\/p>\n<p>          From      the    prayer     made      in    the   writ<\/p>\n<p>application, it appears that the husband of<\/p>\n<p>original petitioner who was in service of the<\/p>\n<p>respondents became traceless in 1995. As he<\/p>\n<p>could    not   be       traced   within      the      statutory<\/p>\n<p>period    petitioner        prayed        for    payment      of<\/p>\n<p>lawful financial entitlements in respect of<\/p>\n<p>the said employee treating him as having died<\/p>\n<p>in harness.\n<\/p>\n<p>          Counter affidavits have been filed in<\/p>\n<p>this case and it is stated that some payments<\/p>\n<p>have been released in favour of the original<\/p>\n<p>petitioner       who       was      widow\/wife         of    the<\/p>\n<p>employee.\n<\/p>\n<p>          Learned        counsel    for    the       petitioner<\/p>\n<p>submits that the details of payments are not<\/p>\n<p>available to the petitioners. Therefore, the<\/p>\n<p>petitioners may be furnished with the details<\/p>\n<p>of the calculation so that they may ascertain<\/p>\n<p>as to whether any other amount still remains<br \/>\n<span class=\"hidden_text\">                    3<\/span><\/p>\n<p>payable in favour of the family members of<\/p>\n<p>the original employee, or not.<\/p>\n<p>          In view of the submissions of learned<\/p>\n<p>counsel     for        the        petitioner,       this      writ<\/p>\n<p>application is disposed of with liberty to<\/p>\n<p>the substituted petitioner no. 1 to approach<\/p>\n<p>and      contact         the        respondent         District<\/p>\n<p>Superintendent of Education, Patna within one<\/p>\n<p>month from today along with a copy of this<\/p>\n<p>order.\n<\/p>\n<p>          If the petitioner meets the District<\/p>\n<p>Superintendent of Education, Patna, he shall<\/p>\n<p>be legally obliged to furnish all the details<\/p>\n<p>and   payments      having         been    released      to    the<\/p>\n<p>widow so far, and shall also furnish details<\/p>\n<p>as to whether any further amount becomes due<\/p>\n<p>to be paid to the petitioner or not. In case<\/p>\n<p>some amounts are admitted to be still due he<\/p>\n<p>shall inform as to within what time the same<\/p>\n<p>shall     be      released          in     favour      of      the<\/p>\n<p>petitioner.\n<\/p>\n<p>          It      is     stated           that      substituted<\/p>\n<p>petitioner        nos.        2     and     3     have        given<\/p>\n<p>authorization for receipt of all benefits by<\/p>\n<p>the     substituted          petitioner         no.1   in     this<\/p>\n<p>regard. The said authorization shall be taken<br \/>\n<span class=\"hidden_text\">                            4<\/span><\/p>\n<p>          into account by the District Superintendent<\/p>\n<p>          of Education, Patna for further release of<\/p>\n<p>          payment.\n<\/p>\n<p>                     Now that the original petitioner has<\/p>\n<p>          died the Bank authorities will consider as to<\/p>\n<p>          under what legal manner her heirs or one of<\/p>\n<p>          the heirs shall be authorized to operate the<\/p>\n<p>          account immediately.\n<\/p>\n<\/p>\n<pre>Arvind\/                          ( J.
