From the charge-sheet papers, he contended<br \/>\nthat there is no direct evidence against the present petitioner. He,<br \/>\nfurther, submitted that one co-accused Urvesh, in whose car,<br \/>\nallegedly, the dead-body was found and which is supposed to have been<br \/>\nused in the commission of the offence, has been released on bail by<br \/>\nthis Court.\n<\/p>\n<p>2.\t\tLearned<br \/>\nAPP, however, drew my attention to the documents on record to contend<br \/>\nthat there is sufficient evidence against the petitioner, of having<br \/>\ncommitted the offence punishable under Section-302 of the Indian<br \/>\nPenal Code.\n<\/p>\n<p>3.\t\tAt<br \/>\nthis stage, when the trial is, yet, to commence,<br \/>\nit would not be appropriate on my part to make any conclusive<br \/>\nobservations with respect to the evidence<br \/>\non record. However, for the purpose of this bail application, I find<br \/>\nthat co-accused has been released on bail and insofar as the present<br \/>\npetitioner is concerned, he was not found on the spot, where the car<br \/>\ncarrying the dead-body had met with accident. Considering<br \/>\nthe above, prima facie,<br \/>\naspects of the matter and since<br \/>\ncharge-sheet is also filed,<br \/>\nI find this is a fit case for granting bail. Under the circumstances,<br \/>\nthe petitioner is ordered to be released on bail in connection with<br \/>\nC.R.-I NO. 167\/2010,<br \/>\nregistered with KAPODARA<br \/>\nPOLICE STATION, Surat,<br \/>\nfor the offences punishable under Sections-302, 364, 365, 120(B),<br \/>\n201, 188 and 114 of the Indian Penal Code, on his furnishing bond of<br \/>\nRs.25,000\/-(Rupees Twenty Five Thousand), with one surety of the like<br \/>\namount to the satisfaction of the lower Court and subject to the<br \/>\nconditions that, he shall:\n<\/p>\n<p>(1).\t\tnot take undue<br \/>\nadvantage of his liberty or abuse his liberty;\n<\/p>\n<p>(2).\t\tnot act in a<br \/>\nmanner injurious to the interest of the prosecution;\n<\/p>\n<p>(3).\t\tmaintain law and<br \/>\norder;\n<\/p>\n<p>(4).\t\tmark his presence<br \/>\nbefore the concerned Police Station on every 1st and 15th<br \/>\nday of English Calendar month between 11:00 a.m. to 2:00 p.m.;\n<\/p>\n<p>(5).\t\tnot leave the<br \/>\nState of Gujarat without prior permission of the Sessions  Judge<br \/>\nconcerned;\n<\/p>\n<p>(6).\t\tfurnish the<br \/>\naddress of his residence at the time of execution of the bond and<br \/>\nshall not change the residence without prior permission of  this<br \/>\nCourt;\n<\/p>\n<p>(7).\t\tsurrender his<br \/>\npassport, if any, to the Lower Court immediately.\n<\/p>\n<p>4.\t\tIf<br \/>\nbreach of any of the above conditions is committed,  the Sessions<br \/>\nJudge concerned will be free  to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>5.\t\tBail<br \/>\nbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>6.\t\tRule<br \/>\nis made absolute.
