The communication is at<br \/>\nAnnexure-F page 20 dated 18.12.2009 wherein it is mentioned that,<br \/>\n&#8216;the management has received applications dated 23.10.2007, 6.2.2008<br \/>\nand 17.9.2009 which were not signed and, therefore, they were not<br \/>\naccepted.  The application dated 18.12.2007 was not received by the<br \/>\nmanagement.  Only applications dated 29.1.2008 and 22.12.2008 were<br \/>\nreceived in acceptable form&#8217;.\n<\/p>\n<p>1.1\t\tThe<br \/>\ncommunication then states that as the person seeking appointment on<br \/>\ncompassionate ground is not fulfilling condition of being fully<br \/>\ndependent upon the deceased, he cannot be given appointment on<br \/>\ncompassionate ground.\n<\/p>\n<p>2.\t\tLearned<br \/>\nadvocate Mr.Acharya submitted that in view of the provisions<br \/>\npertaining to the appointment on compassionate ground of dependent,<br \/>\ncopy of the relevant provisions from Swamy&#8217;s Hand Book 2006 are at<br \/>\npages 9 and 10 of the petition wherein the term &#8216;dependent family<br \/>\nmember&#8217; is defined which reads as under.\n<\/p>\n<p>&#8220;Dependent<br \/>\nfamily member means (a) spouse; (b) son\/daughter (including adopted<br \/>\nson\/adopted daughter) and (c) brother or sister in the case of<br \/>\nunmarried Government servant \/ member of the Armed Forces at the time<br \/>\nof his death in harness \/ retirement on medical grounds, as the case<br \/>\nmay be.&#8221;\n<\/p>\n<p>2.1\t\tThere<br \/>\nare exceptions to the aforesaid provisions which read as under.\n<\/p>\n<p>&#8220;Exceptions.-\n<\/p>\n<p><span class=\"hidden_text\">(1)<\/span><\/p>\n<p>\t\tIn exceptional circumstances, with the prior approval of the<br \/>\nSecretary of the Ministry \/ Department concerned, the appointment on<br \/>\ncompassionate grounds may be considered even when there is an earning<br \/>\nmember in the family of the deceased.\n<\/p>\n<p>(2)\t\tIf<br \/>\nthe deceased was unmarried, one of the dependent brothers\/sisters<br \/>\nwill be eligible for consideration, on giving an undertaking that<br \/>\nhe\/she will look after the other family members who were dependent on<br \/>\nthe deceased Government servant.&#8221;\n<\/p>\n<p>3.\t\tLearned<br \/>\nadvocate Mr.Siraj Gori appearing for the respondent invited attention<br \/>\nof the Court to the affidavit filed by one Vinod Shukla, Principal<br \/>\nIn-charge, Institute of Hotel Management Catering Technology and<br \/>\nApplied Nutrition, Ahmedabad and he invited attention of the Court to<br \/>\nthe contents of paragraphs 7 and 8 of the reply.  Learned advocate<br \/>\nfor the respondent submitted that in view of the averments made in<br \/>\nthe aforesaid two paragraphs, it is clear that the petitioner was not<br \/>\ndependent of the deceased father. That being so, his case is rightly<br \/>\nnot considered by the management.\n<\/p>\n<p>4.\t\tHaving<br \/>\nheard learned advocates for the parties, the Court finds no substance<br \/>\nin the petition.  The petition is dismissed.
