Learned Trial Court vide order dated<br \/>\n08.12.2009 allowed the said application. Being aggrieved by the said<br \/>\norder, present petitioners have preferred present petition.\n<\/p>\n<p>3.\t\tIt<br \/>\nis submitted by Mr.Patel, learned Advocate for the petitioners that<br \/>\nit was within the knowledge of respondents herein &#8211; original<br \/>\nplaintiff that they were in possession of the suit property since<br \/>\n1997 &#8211; 1998 and inspite of that they did not choose to prefer<br \/>\napplication for joining present petitioners as party and therefore,<br \/>\nqua present petitioners the suit is time barred.  It is also<br \/>\nsubmitted that application for joining present petitioners as party<br \/>\ndefendants is preferred on 03.10.2009 and without considering this<br \/>\naspect learned Trial Court has allowed the application and committed<br \/>\nerror in allowing the said application.   It is also submitted that<br \/>\nlearned Trial Court committed error in holding that suit has been<br \/>\nfiled for possession and therefore, petitioners are required to be<br \/>\njoined as party, but, in fact there was no prayer for possession in<br \/>\nthe plaint. Therefore, it is requested to allow the petition.\n<\/p>\n<p>4.\tPetition is<br \/>\nopposed by Mr.Jayant Bhatt, learned Advcoate for respondent Nos.1 and\n<\/p>\n<p>2. It is submitted by Mr.Bhatt that original plaintiffs filed<br \/>\napplication Exh.157 for impleading present petitioners as proposed<br \/>\ndefendants to the suit. It is submitted that it was pleaded that the<br \/>\nsuit land, during the pendency of the suit, has been transferred in<br \/>\nfavour of proposed defendants. It is submitted that therefore, they<br \/>\nwere necessary and proper party and are required to be impleaded as<br \/>\nparty defendants to the suit.   It is submitted by Mr.Bhatt, that<br \/>\nduring pendency of suit and though injunction was granted against<br \/>\noriginal defendants they have transferred two shops of suit property<br \/>\nto the present petitioners.  Therefore, it is requested to dismiss<br \/>\nthe petition.\n<\/p>\n<p>5.\t\tHeard<br \/>\nlearned Advocates for the parties.\n<\/p>\n<p>6.\t\tThis Court has<br \/>\ngone through the impugned order passed by the learned Trial Court.<br \/>\nThe suit is filed in the year 1993 and though injunction was granted<br \/>\nand was in operation in favour of respondents herein &#8211; original<br \/>\nplaintiffs, original defendants have transferred two shops of suit<br \/>\nproperty to proposed defendants.  The contention on behalf of the<br \/>\npetitioner with regard to issue of limitation is concerned, it can be<br \/>\nraised before the learned Trial Court and it can only be decided<br \/>\nduring trial by the learned Trial Court.\n<\/p>\n<p>7.\t\tLearned<br \/>\nAdvocate for the petitioners herein has failed to show that order<br \/>\npassed by the learned Trial Court is without jurisdiction and in<br \/>\nopinion of this Court, no jurisdictional error has been committed by<br \/>\nthe learned Trial Court.  Hence, under Article 227 of the<br \/>\nConstitution of India, question does not arise to entertain this<br \/>\npetition as no error has been committed by the learned Trial Court.\n<\/p>\n<p>8.\t\tHon&#8217;ble<br \/>\nSupreme Court in the case of Jai Singh and Others v\/s.<br \/>\nMunicipal Corporation of Delhi and Ors. reported in (2010)<br \/>\n9 SCC 385 in para 15 has observed as under :-\n<\/p>\n<p>&#8220;15.\t\tWe<br \/>\nhave anxiously considered the submissions of the learned counsel.<br \/>\nBefore we consider the factual and legal issues involved herein, we<br \/>\nmay notice certain well recognized principles<br \/>\ngoverning the exercise of jurisdiction by<br \/>\nthe High Court under Article 227 of the Constitution of India.<br \/>\nUndoubtedly the High Court, under this Article, has the<br \/>\njurisdiction to ensure that all subordinate courts as well as<br \/>\nstatutory or quasi judicial tribunals, exercise the powers vested in<br \/>\nthem, within the bounds of their authority. The High Court has the<br \/>\npower and the jurisdiction to ensure that they act in accordance with<br \/>\nwell established principles of law. The High Court is vested with the<br \/>\npowers of superintendence and\/or judicial revision, even in matters<br \/>\nwhere no revision or appeal lies to the High Court. The jurisdiction<br \/>\nunder this Article is, in some ways, wider than the power and<br \/>\njurisdiction under Article 226 of the Constitution of India. It is,<br \/>\nhowever, well to remember the well known adage that greater the<br \/>\npower, greater the care and caution in exercise thereof. The High<br \/>\nCourt is, therefore, expected to exercise such wide powers with great<br \/>\ncare, caution and circumspection. The exercise of jurisdiction must<br \/>\nbe within the well recognized constraints. It can not be exercised<br \/>\nlike a &#8216;bull in a china shop&#8217;, to correct all errors of<br \/>\njudgment of a court, or tribunal, acting within the limits of its<br \/>\njurisdiction. This correctional jurisdiction can be exercised in<br \/>\ncases where orders have been passed in grave dereliction of duty or<br \/>\nin flagrant abuse of fundamental principles of law or justice. The<br \/>\nHigh Court cannot lightly or liberally act as an appellate court and<br \/>\nre-appreciate the evidence. Generally, it can not substitute its own<br \/>\nconclusions for the conclusions reached by the courts below or the<br \/>\nstatutory\/quasi judicial tribunals. The power to re-appreciate<br \/>\nevidence would only be justified in rare and exceptional situations<br \/>\nwhere grave injustice would be done unless the High Court interferes.<br \/>\nThe exercise of such discretionary power would depend on the peculiar<br \/>\nfacts of each case, with the sole objective of ensuring that there is<br \/>\nno miscarriage of justice.&#8221;\n<\/p>\n<p>9.\t\tNow<br \/>\nso far as factual aspect and evidence is concerned, this Court has<br \/>\nvery limited power to interfere and so this Court is not giving any<br \/>\nopinion regarding merits of the case and issues involved in the case.\n<\/p>\n<p>10.\t\tIn<br \/>\nview of above, present petition is dismissed. Rule discharged.  At<br \/>\nthis stage, learned Advocate for the petitioner requests that interim<br \/>\nrelief granted by this Court be continued for 4(four) weeks.  The<br \/>\nrequest is granted.
