Justice K.T.SANKARAN\n\n Dated :25\/06\/2009\n\n O R D E R\n                          K.T.SANKARAN, J.\n                      -------------------------------\n                          B.A.No.3407 of 2009\n                      ------------------------------\n               Dated this the 25th day of June, 2009\n\n\n\n\n                                ORDER\n<\/pre>\n<p>       This is an application for bail under Section 439 of the Code of<\/p>\n<p>Criminal Procedure. The petitioner is the accused in Crime No.55 of<\/p>\n<p>2009 of Chengannur Excise Range.\n<\/p>\n<p>      2.    The offences alleged against the petitioner are under<\/p>\n<p>Sections 8(1) and (2) of the Abkari Act.\n<\/p>\n<p>      3.    The prosecution case is that on 10.6.2009, the accused<\/p>\n<p>was found in possession of one litre of coloured arrack. The petitioner<\/p>\n<p>surrendered on 11.6.2009 and she is in judicial custody.<\/p>\n<p>      4.    Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the petitioner,<\/p>\n<p>the nature of the offence and the present stage of investigation, I am<\/p>\n<p>of the view that bail can be granted to the petitioner.<\/p>\n<p>      5.    The petitioner shall be released on bail on her executing<\/p>\n<p>bond for Rs.25,000\/- with two solvent sureties for the like amount to<\/p>\n<p>the satisfaction of the Judicial Magistrate of the First Class,<\/p>\n<p>Chengannur, subject to the following conditions:<\/p>\n<p><span class=\"hidden_text\">BA No.3407\/2009                      2<\/span><\/p>\n<p>a)   The petitioner shall report before the investigating officer<br \/>\n     between 9 A.M.        and 11 A.M. on all Mondays, till the final<br \/>\n     report is filed or until further orders;<\/p>\n<p>b)   The petitioner shall appear before the investigating officer for<br \/>\n     interrogation as and when required;\n<\/p>\n<p>c)   The petitioner shall not try to influence the prosecution witnesses<br \/>\n     or tamper with the evidence;\n<\/p>\n<p>d)   The petitioner shall not commit any offence or indulge in any<br \/>\n     prejudicial activity while on bail;\n<\/p>\n<p>e)   In case of breach of any of the conditions mentioned above, the<br \/>\n     bail shall be liable to be cancelled.\n<\/p>\n<p>\n     The Bail Application is allowed as above.<\/p>\n<p>                                                  K.T.SANKARAN,<br \/>\n                                                     JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Valsala vs State Of Kerala Represented By The on 25 June, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 3407 of 2009() 1.
