Public Prosecutor waives service of<br \/>\n\tnotice of rule on behalf of the respondent &#8211; State of Gujarat.\n<\/p>\n<p>2.\tHaving<br \/>\n\tregard to the facts of the case, the application is taken up for<br \/>\n\thearing today.\n<\/p>\n<p>3.\tBy<br \/>\n\tfiling instant application, the applicant &#8211; convict prisoner,<br \/>\n\twho has been enlarged on temporary bail for a period of 15 days by<br \/>\n\tthis Court on 25.1.2011 in Criminal Misc. Application No.758 of<br \/>\n\t2011, has prayed to extend the period of temporary bail for a<br \/>\n\tfurther period of four weeks on the ground stated in the<br \/>\n\tapplication.\n<\/p>\n<p>4.\tHaving<br \/>\n\theard Ms. KD Parmar, learned advocate for the applicant and Mr. LB<br \/>\n\tDabhi, learned APP for the respondent &#8211; State of Gujarat and<br \/>\n\tupon perusal of the order dated 25.1.2011 passed by this Court in<br \/>\n\tCriminal Misc. Application No.758 of 2011 granting him temporary<br \/>\n\tbail for a period of 15 days for the purpose of performing operation<br \/>\n\tof hernia and also the certificate dated 8.2.2011 certifying that<br \/>\n\toperation has already been performed and he required bed rest for a<br \/>\n\tfurther period of four weeks so also the jail remark sheet, we deem<br \/>\n\tit expedient to  accede to the request made by the applicant by<br \/>\n\textending the period of temporary bail, granted to him vide order<br \/>\n\tdated 25.1.2011 by this Court in Criminal Misc. Application No.758<br \/>\n\tof 2011, upto 26.2.2011.\n<\/p>\n<p>5.\tFor<br \/>\n\tthe foregoing reasons, the application succeeds in part.<br \/>\n\tAccordingly, it is partly allowed. The period of temporary bail<br \/>\n\tgranted to the applicant by this Court on 25.1.2011 in Criminal<br \/>\n\tMisc. Application No.758 of 2011, shall stand extended upto<br \/>\n\t26.2.2011 on the same terms and conditions.
