KRISHNAN, J.\n                 ...........................................\n                        A.S.NO.33 OF 2000\n                 .............................................\n          Dated this the 2nd day of November, 2010.\n\n                        J U D G M E N T\n<\/pre>\n<p>     This is an appeal preferred against the judgment and<\/p>\n<p>decree of the    1st Additional Subordinate                    Judge&#8217;s Court,<\/p>\n<p>Thiruvananthapuram in O.S.No.542\/1992.                        The suit is one<\/p>\n<p>for  compensation for          libellous         publication.     An article<\/p>\n<p>published in   the Malayalam              daily       &#8220;Thaniniram&#8221;     is the<\/p>\n<p>subject matter for this defamatory suit. Unfortunately the<\/p>\n<p>first defendant moved an application for adjournment and<\/p>\n<p>the trial court dismissed          that application. Thereafter it<\/p>\n<p>proceeded to pass judgment in the absence of evidence of<\/p>\n<p>the first defendant after setting him ex-parte.                 He moved an<\/p>\n<p>application for setting aside the ex-parte decree against<\/p>\n<p>him which was also dismissed for default.<\/p>\n<p>      Now the subject matter requires serious attention. It<\/p>\n<p>is true that there are laches on the part of the                         first<\/p>\n<p>defendant.    But    interest of justice                requires   that    an<\/p>\n<p>opportunity has to be given to him. Unfortunately one<\/p>\n<p>defendant has contested the suit and the other defendant<\/p>\n<p>has not contested the suit. It is a joint case where one<\/p>\n<p>depends on the other. So it has become necessary for this<\/p>\n<p><span class=\"hidden_text\">                              : 2 :<\/span><br \/>\nA.S.NO.33 OF 2000<\/p>\n<p>Court to set aside the entire judgment decree and direct the<\/p>\n<p>trial court to proceed after affording opportunity to all<\/p>\n<p>concerned to produce both documentary as well as oral<\/p>\n<p>evidence in support of their respective contentions and then<\/p>\n<p>dispose of the matter in accordance with law. For the laches<\/p>\n<p>the first defendant   has to pay a cost of Rs.3,000\/= to the<\/p>\n<p>plaintiff. If the said amount is paid on or before 4.12.2010<\/p>\n<p>and a receipt is produced, the court can restore the case<\/p>\n<p>back to file and proceed with the matter as stated above. In<\/p>\n<p>any event the payment is not accepted, the appellant herein<\/p>\n<p>is at liberty to deposit the    amount before the trial court.<\/p>\n<p>Being an old matter expeditious attempt shall be made to<\/p>\n<p>dispose of the case.  The first defendant shall also take out<\/p>\n<p>notice to the second defendant so that he can also be heard<\/p>\n<p>in the matter. If the amount is not paid or deposited within<\/p>\n<p>the stipulated time, this appeal will stand     automatically<\/p>\n<p>dismissed without any further orders. Parties are directed to<\/p>\n<p>appear before the trial court on 4.12.2010.<\/p>\n<p>                                   M.N.
