Justice K.T.SANKARAN\n\n Dated :16\/12\/2009\n\n O R D E R\n                           K.T.SANKARAN, J.\n                  ---------------------------------------------\n                         B.A.No.6231 of 2009\n                  ---------------------------------------------\n            Dated this the 18th day of December, 2009\n\n\n                               ORDER\n<\/pre>\n<p>      This is an application for anticipatory bail under Section<\/p>\n<p>438 of the Code of Criminal Procedure. The petitioner is the sole<\/p>\n<p>accused in Crime No.549 of 2009 of Thrissur Town East Police<\/p>\n<p>Station.\n<\/p>\n<p>     2.   The offences alleged against the petitioner are under<\/p>\n<p>Sections 406, 418 and 420 of the Indian Penal Code.<\/p>\n<p>     3.   When the Bail Application came up for hearing on 2nd<\/p>\n<p>December, 2009, the following order was passed:<\/p>\n<blockquote><p>                   &#8220;After having heard the learned counsel<\/p>\n<p>           for the petitioner and the learned Public<\/p>\n<p>           Prosecutor, I am of the view that before disposing<\/p>\n<p>           of the Bail Application, an opportunity should be<\/p>\n<p>           given to the petitioner to appear before the<\/p>\n<p>           investigating officer. Accordingly, there will be a<\/p>\n<p>           direction to the petitioner to appear before the<\/p>\n<p>           investigating officer at 9 A.M. on 10th and 11th<\/p>\n<p>           December, 2009.\n<\/p><\/blockquote>\n<blockquote><p>                Post on 16.12.2009.\n<\/p><\/blockquote>\n<blockquote><p>                It is submitted by the learned Public<\/p>\n<p>           Prosecutor that the petitioner will not be arrested<\/p>\n<p><span class=\"hidden_text\">BA No.6231\/2009                     2<\/span><\/p>\n<p>            until further orders in connection with Crime No.<\/p>\n<p>            549 of 2009 of Thrissur Town East Police<\/p>\n<p>            Station.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>                  The petitioner shall produce copy of this<\/p>\n<p>            order before the investigating officer.<\/p>\n<\/blockquote>\n<blockquote><p>                  The investigating officer shall make every<\/p>\n<p>            endeavour to ensure the presence of the de facto<\/p>\n<p>            complainant so as to afford an opportunity to the<\/p>\n<p>            parties to settle the disputes.<\/p><\/blockquote>\n<p>      4.    It is submitted by the learned counsel for the<\/p>\n<p>petitioner that the disputes and differences between the<\/p>\n<p>petitioner and the de facto complainant have been settled<\/p>\n<p>between them.\n<\/p>\n<p>      5.    The learned Public Prosecutor submitted that the<\/p>\n<p>de facto complainant also appeared before the investigating<\/p>\n<p>officer and the matter was settled between the parties.         He<\/p>\n<p>added that in view of the settlement, it is not necessary to arrest<\/p>\n<p>the petitioner.
