Justice K.SURENDRA MOHAN\n\n Dated :07\/01\/2011\n\n O R D E R\n            R.BASANT &amp; K.SURENDRA MOHAN, JJ.\n                     ***********************\n                   W.P(C) No.35587 of 2010\n                  *****************************\n             Dated this the 7th day of January, 2011\n\n                          JUDGMENT\n<\/pre>\n<p>BASANT, J.\n<\/p>\n<p>      Petitioner has come to this Court with this petition seeking<\/p>\n<p>directions under Article 226 of the Constitution of India to<\/p>\n<p>respondents 1 to 3 to afford police protection for her against the<\/p>\n<p>alleged illegal, violent and culpable conducts of the 5th<\/p>\n<p>respondent.    The 4th respondent is her husband.         The 5th<\/p>\n<p>respondent is a friend of the 4th respondent. He is also the<\/p>\n<p>uncle&#8217;s son of the 4th respondent. According to the petitioner,<\/p>\n<p>the 4th respondent is employed abroad. The 5th respondent is<\/p>\n<p>available in India. The petitioner&#8217;s daughter had fallen in love<\/p>\n<p>with a person and a petition for issue of a writ of habeas corpus<\/p>\n<p>was filed before this Court. Ext.R5(d) is the judgment passed in<\/p>\n<p>that case. According to the petitioner, the 5th respondent is<\/p>\n<p>vexing, tormenting, harassing and indulging in objectionable<\/p>\n<p>conduct against the petitioner.    She prayed that appropriate<\/p>\n<p>directions may be issued to respondents 1 to 3 to abate such<\/p>\n<p>hardship to her from the 5th respondent.\n<\/p>\n<p>      2.    Respondents 4 and 5 have entered appearance. They<\/p>\n<p>totally deny the allegations. The 4th respondent asserts that he<\/p>\n<p><span class=\"hidden_text\">W.P(C) No.35587 of 2010          2<\/span><\/p>\n<p>has already divorced the petitioner in accordance with law and<\/p>\n<p>that he has nothing more to do with the petitioner. According to<\/p>\n<p>the 4th and 5th respondents, the petitioner is residing in a house<\/p>\n<p>which belonged originally to the 4th respondent and which has<\/p>\n<p>later been transferred to the 5th respondent.         The learned<\/p>\n<p>counsel for the 4th respondent submits that in view of the<\/p>\n<p>divorce, the 4th respondent shall not proceed to the petitioner<\/p>\n<p>hereafter. The learned counsel on behalf of the 5th respondent<\/p>\n<p>accepts that both the 4th and 5th respondents shall not in any way<\/p>\n<p>cause any difficulties or hardship to the petitioner. They have<\/p>\n<p>not done so hitherto and shall not do so hereafter.          False<\/p>\n<p>allegations of improper behaviour are being raised against the<\/p>\n<p>petitioner by respondents 4 and 5 with malicious motives, allege<\/p>\n<p>respondents 4 and 5.\n<\/p>\n<p>      3.    The     learned Government    Pleader    after  taking<\/p>\n<p>instructions from respondents 1 to 3 submits that at the moment,<\/p>\n<p>the police do not perceive any threat to the life of the petitioner<\/p>\n<p>or her person. If there be any such instance, the petitioner can<\/p>\n<p>complain and respondents 1 to 3 shall take necessary action.<\/p>\n<p>That undertaking may be recorded and proceedings may be<\/p>\n<p>closed, submits the learned Government Pleader.<\/p>\n<p><span class=\"hidden_text\">W.P(C) No.35587 of 2010         3<\/span><\/p>\n<p>      4.    The learned counsel for respondents 4 and 5 further<\/p>\n<p>submit that civil proceedings have already been initiated against<\/p>\n<p>the petitioner by the 5th respondent seeking recovery of the<\/p>\n<p>property in which the petitioner is residing, ie. O.S.No.242 of<\/p>\n<p>2009 on the file of the Munsiff Court, Parappanangadi. The<\/p>\n<p>learned counsel for respondents 4 and 5 submits that except to<\/p>\n<p>prosecute that litigation claiming recovery, they shall not in any<\/p>\n<p>way proceed to the property or cause any hardship to the<\/p>\n<p>petitioner.\n<\/p>\n<p>      5.    We are satisfied, in these circumstances, that no<\/p>\n<p>further specific directions are necessary.       We record the<\/p>\n<p>submission of the learned counsel for respondents 4 and 5 that<\/p>\n<p>respondents 4 and 5 shall not in any way proceed to the<\/p>\n<p>residence of the petitioner or cause hardship, inconvenience or<\/p>\n<p>harassment to the petitioner. We record the submission of the<\/p>\n<p>learned Government Pleader that if there be any such genuine<\/p>\n<p>complaint of contumacious and culpable acts on the part of<\/p>\n<p>respondents 4 and 5, respondents 1 to 3 shall afford necessary<\/p>\n<p>protection to the petitioner. We further specifically record the<\/p>\n<p>submission of respondents 4 and 5 that they shall not in any way<\/p>\n<p>cause obstruction to the residence of the petitioner in her<\/p>\n<p><span class=\"hidden_text\">W.P(C) No.35587 of 2010          4<\/span><\/p>\n<p>present residence subject of course to the right of the 5th<\/p>\n<p>respondent to recover the property in accordance with law<\/p>\n<p>through the civil court. We further record that though the 4th<\/p>\n<p>respondent claimed that he has divorced the petitioner, the<\/p>\n<p>learned counsel for the petitioner submits that there has been no<\/p>\n<p>divorce in accordance with law and the petitioner is unaware of<\/p>\n<p>and does not accept any such divorce.\n<\/p>\n<p>     6.     We are not going into all the other disputes between<\/p>\n<p>the parties. We intend to express no opinion on those aspects.<\/p>\n<p>For the purpose of this case, we are satisfied that appropriate<\/p>\n<p>directions can be issued to respondents 1 to 3, as agreed.<\/p>\n<p>     7.     This Writ Petition is accordingly allowed in part as<\/p>\n<p>agreed.
