    The petitioner seeks to challenge the non consideration<\/p>\n
of  his   application  for   selection   to   the  post  of<\/p>\n
Demonstrator in the service of the first respondent.<\/p>\n
    2.   The petitioner is already working in the same<\/p>\n
institution and he started his career as Cleaner in the<\/p>\n
first respondent Institution.   His mother was also working<\/p>\n
as a Cleaner there.   He was having Pre-degree at the time<\/p>\n
of appointment.    Then he pursued his studies for B.Sc<\/p>\n
course in Hospitality Science with the permission of the<\/p>\n
first respondent after availing three years’ leave without<\/p>\n
allowance.   After obtaining Degree, he rejoined duty as<\/p>\n
Cleaner from 31\/05\/2007.\n<\/p>\n
    3.   Staking his claim for promotion, he approached the<\/p>\n
first respondent and thereafter, approached this Court by<\/p>\n
filing  W.P.(C).No.33422\/2007   for  a   direction  to  the<\/p>\n
respondents  to  grant   him  promotion   to  the  post  of<\/p>\n
Demonstrator after keeping one out of 12 vacancies for<\/p>\n
promotion for existing employees.     This Court by Ext.P1<\/p>\n
Judgment dated 13\/11\/2007 directed the first respondent to<\/p>\n
consider his request.    Thereafter, by Ext.P2 Order dated<\/p>\n
30\/11\/2007 he was promoted as Lab Attendant and posted in<\/p>\n
W.P.(C). No.29767\/2008
\n                                -:2:-<\/span><\/p>\n
Food Craft Institute, Thodupuzha.       The process of selection<\/p>\n
to the post of Demonstrator was initiated by the first<\/p>\n
respondent as per Ext.P3 notification dated 19\/06\/2007.       It<\/p>\n
appears     that    this  notification   was  not  pursued and,<\/p>\n
thereafter,      another   notification   dated  24\/10\/2007 was<\/p>\n
published and, he submitted an application as per Ext.P5.<\/p>\n
Alleging that the application is not being considered, this<\/p>\n
writ petition was filed.      It is averred in paragraph (4) of<\/p>\n
the writ petition that a written test and interview was<\/p>\n
conducted on 15\/06\/2008 and 02\/07\/2008 respectively.        The<\/p>\n
copies of the appointment orders have been produced as<\/p>\n
Exts.P6 to P15 and the selected candidates have also been<\/p>\n
arrayed as party respondents.          The first respondent has<\/p>\n
filed a detailed counter affidavit.\n<\/p>\n
     4.      Heard both sides.      The learned counsel for the<\/p>\n
petitioner submitted that after the petitioner obtained the<\/p>\n
qualification, he was entitled for promotion.       But, inspite<\/p>\n
of the direction by this Court in Ext.P1 Judgment, he was<\/p>\n
not given reply also.         Therefore, the promotion granted<\/p>\n
then    as   Lab    Attendant is   not  made  in  terms  of the<\/p>\n
directions in Ext.P1 Judgment.        It is therefore, submitted<\/p>\n
that in the light of directions in Ext.P1 Judgment, his<\/p>\n
application submitted as per Ext.P5 ought to have been<\/p>\n
considered and the rejection of the application is illegal.<\/p>\n

     5.      In   the  counter  affidavit   filed  by  the  first<\/p>\n
respondent, the stand taken is that the respondent has<\/p>\n
fully complied with the directions in Ext.P1 Judgment by<\/p>\n
promoting the petitioner as Lab Attendant on 30\/11\/2007.<\/p>\n
Pursuant     to    notification  dated   19\/06\/2007,  because   of<\/p>\n
certain complaints, the selection could not be proceeded<\/p>\n
with.    Thereafter, the Executive Committee took a decision<\/p>\n
to issue a fresh notification for filling-up the post of<\/p>\n
six Instructors and 12 Demonstrators.\n<\/p>\n
     6.      The qualification for the post of Demonstrator as<\/p>\n
averred in the counter affidavit is the following:-<\/p>\n
                   \"Degree\/Diploma    in   Hotel   Management    &\n             Catering   Technology    (3yrs\/4yrs  Course)  from a\n             recognised   University\/State    Board  of  Technical\n<\/pre>\n
             Education\/National Council for Hotel Management &
\n             Catering    Technology,   New   Delhi   or  from   an
\n             Institute having AICTE approval with at least one
\n             year practical experience in a reputed Hotel or a
\n             Certificate course passed with at least 60% marks
\n             in the relevant trade from National Council for
\n             Hotel    Management   &   Catering   Technology\/State
\n             Technical Board and 3yrs practical experience in
\n             a reputed Hotel.”\n<\/p>\n
The stand taken is that the petitioner is not having the<\/p>\n
requisite      experience   qualification,    namely,   one  year<\/p>\n
practical experience in a reputed Hotel.<\/p>\n

     7.      The learned counsel for the petitioner further<\/p>\n
submitted that the adoption of the Rules is only in the<\/p>\n
year 2008 and, therefore the experience required as per the<\/p>\n
notification cannot stand scrutiny.         This contention does<\/p>\n
not arise for consideration in the light of the fact that<\/p>\n
the notification or the decision fixing the qualification<\/p>\n
has not been challenged in the writ petition.<\/p>\n
     8.      Therefore, what remains to be considered is the<\/p>\n
claim of the petitioner for appointment as Demonstrator on<\/p>\n
the basis of Ext.P1 Judgment.        In fact, in Ext.P1 Judgment,<\/p>\n
the direction was to only consider his representation.<\/p>\n
This Court had no occasion to adjudicate the merits of the<\/p>\n
candidate therein.        The petitioner could have, if he was<\/p>\n
aggrieved     by    the  promotion   as  Lab  Attendant,   either<\/p>\n
complained to the first respondent for not promoting him as<\/p>\n
Demonstrator or approached this Court.\n<\/p>\n
     9.      The learned counsel for the petitioner submitted<\/p>\n
that his grievance regarding the non granting of promotion<\/p>\n
as Demonstrator has been highlighted in the writ petition<\/p>\n
and reliefs have been sought for in that regard also.<\/p>\n
     10. The        petitioner has    automatically  been   found<\/p>\n
eligible for promotion as Lab Attendant.        The notification<\/p>\n
as   regards     the   post  of Demonstrator   is  not  for   any<\/p>\n
appointment by way of promotion but for direct recruitment.<\/p>\n

True that he also applied to the post.           The claim for<\/p>\n
promotion and the claim for appointment by way of direct<\/p>\n
recruitment     are    quite  different because  these  two are<\/p>\n
different streams.       Therefore, when he is opting for direct<\/p>\n
recruitment, the petitioner will have to fulfil all the<\/p>\n
qualifications required including experience.      In that view<\/p>\n
of the matter, as the petitioner had submitted application<\/p>\n
pursuant to the notification for appointment by direct<\/p>\n
recruitment       unless   and   until  he   fulfils   all  the<\/p>\n
qualifications namely, academic as well as experience, his<\/p>\n
application could not have been considered by the first<\/p>\n
respondent.       In that view of the matter, the rejection of<\/p>\n
the application cannot be faulted.         What remains is the<\/p>\n
claim for promotion as Demonstrator.         It is pointed out<\/p>\n
that the petitioner has not received any reply so far,<\/p>\n
inspite of the direction issued in Ext.P1 Judgment.         The<\/p>\n
first respondent has stated in the counter affidavit that<\/p>\n
due promotion was given to the petitioner as Lab Attendant.<\/p>\n
     11. Therefore, the writ petition is dismissed.      In the<\/p>\n
light of      the    complaint  raised by  the  petitioner  that<\/p>\n
inspite of Ext.P1 Judgment no formal reply was given after<\/p>\n
considering his claim, the first respondent will furnish a<\/p>\n
reply after considering his claim, if any, for promotion as<\/p>\n
Demonstrator within a period of two months from the date of<\/p>\n

receipt of a copy of this Judgment and the dismissal of the<\/p>\n
writ petition will not stand in the way of considering the<\/p>\n
