The order of Division Bench whose<\/p>\n<p>                    violation is being alleged contains a conditional<\/p>\n<p>                    direction to the respondents\/concerned respondents to<\/p>\n<p>                    consider the case of the petitioners for appointment on<\/p>\n<p>                    the post of Panchayat Sevak if in future decision is<\/p>\n<p>                    taken by the Government for appointment on the post<\/p>\n<p>                    of Panchayat Sevak. CWJC No. 1936 of 2004 which<\/p>\n<p>                    concerns this petitioner exclusively was disposed of<\/p>\n<p>                    with a further direction to the respondent to consider<br \/>\n<span class=\"hidden_text\">                 2<\/span><\/p>\n<p>the case of the petitioners for relaxation of age for<\/p>\n<p>appointment on the post Panchayat Sevak if the<\/p>\n<p>Government takes a decision for appointment on the<\/p>\n<p>post of Panchayat Sevak in future.\n<\/p>\n<p>          3.   It is the firm stand of the State as<\/p>\n<p>reflected by averment in the show-cause that after the<\/p>\n<p>Bihar Panchayat Raj Act, 1993, a new post of<\/p>\n<p>Panchayat Secretary with different responsibilities<\/p>\n<p>and qualification was created and it requires to be<\/p>\n<p>filled up by the State Government and hence there<\/p>\n<p>was no scope to continue with the past system of<\/p>\n<p>selecting qualified Dalpati for the post of Panchayat<\/p>\n<p>Sevak.\n<\/p>\n<p>          4. A reliance has been placed upon a recent<\/p>\n<p>Division Bench judgment of this Court in the case of<\/p>\n<p><a href=\"\/doc\/103325660\/\">State of Bihar V. Subhash Chandra Shukla<\/a> reported<\/p>\n<p>in (2009) 4 PLJR 569 to highlight the fact that the<\/p>\n<p>Division Bench accepted the aforesaid submission<\/p>\n<p>and held that after the 1993 Act a Dalpati cannot as a<\/p>\n<p>matter of right be considered for appointment as<\/p>\n<p>Panchayat Secretary. Paragraph-15 of that judgment<\/p>\n<p>was also placed before us in support of the stand of<br \/>\n<span class=\"hidden_text\">                  3<\/span><\/p>\n<p>the State Government that it was under compulsion to<\/p>\n<p>appoint 531 persons as Panchayat Secretaries from<\/p>\n<p>amongst Dalpatis on account of some earlier Court<\/p>\n<p>decisions having attained finality.<\/p>\n<p>          5. Before us, in the present case the State<\/p>\n<p>has taken a firm stand that petitioner&#8217;s case is not<\/p>\n<p>covered by any earlier decision of this Court which<\/p>\n<p>has attained finality and hence in his case the stand of<\/p>\n<p>the Government is that his claim cannot be considered<\/p>\n<p>for appointment on the post of Panchayat Sevak<\/p>\n<p>because beyond persons required to be accommodated<\/p>\n<p>on account of Court&#8217;s orders which have attained<\/p>\n<p>finality, the State Government has taken a clear<\/p>\n<p>decision not to make any further such appointments<\/p>\n<p>from Dalpatis to the post of Panchayat Secretary.<\/p>\n<p>          6. The requirement to consider relaxation<\/p>\n<p>of age would have arisen only if there was a decision<\/p>\n<p>for making any further appointment from the post of<\/p>\n<p>Panchayat Sevak\/Panchayat Secretary.<\/p>\n<p>          7. In the facts of the case, we find no good<\/p>\n<p>ground to take action against the opposite parties<\/p>\n<p>under    contempt     jurisdiction.
