    This petition is filed under Article 226 of<\/p>\n
Constitution of India for a writ of mandamus<\/p>\n
directing respondents 5 and 6 to authorize any<\/p>\n
superior officer not below the rank of Deputy<\/p>\n
Superintendent of Police to investigate Crime<\/p>\n
1119\/2009 registered for the offences under<\/p>\n
sections 143, 147, 148, 447, 323, 324 and   326<\/p>\n
read with section 149 of Indian Penal Code.<\/p>\n
Case of the petitioner is that there was no<\/p>\n
proper investigation  and the elder brother of<\/p>\n
the petitioner  was   murdered pursuant to the<\/p>\n
assault made by the accused and though accused<\/p>\n
3, 6 and 7 were also involved, they were<\/p>\n
subsequently deleted and a new accused was<\/p>\n
added as fifth accused and as there is no<\/p>\n
chance for a fair and   proper investigation, a<\/p>\n

direction       is  to  be  issued  to  conduct   proper<\/p>\n
investigation by an officer not below the rank of<\/p>\n
Deputy Superintendent of Police.       Sub Inspector of<\/p>\n
Police,      Kundara   Police  Station  has    filed   a<\/p>\n
statement which reveals that his predecessor Sub<\/p>\n
Inspector       had investigated the case and he filed a<\/p>\n
report     before    the  court  deleting  the  original<\/p>\n
accused 3, 6 and 7 and adding fifth accused as an<\/p>\n
additional         accused  and   a  final  report   was<\/p>\n
submitted before court on 25.2.2010 and though<\/p>\n
cognizance was taken, trial is not started.          The<\/p>\n
relevant portion of the statement in paragraph 5 of<\/p>\n
the statement reads:-\n<\/p>\n
         “It is also born out from the<\/p>\n
         case    diary   that  additional<\/p>\n
         statement of the petitioner<\/p>\n
         was not recorded by the then<\/p>\n
         Sub Inspector of Police, even<\/p>\n
         though name of the 3 persons<\/p>\n
         already arrayed in the First<\/p>\n
         Information     Statement   were<\/p>\n

         deleted.      Though the final<\/p>\n
         report     has   been  submitted<\/p>\n
         before     the   Judicial  First<\/p>\n
         Class      Magistrate   Court-I,<\/p>\n
         Kollam      trial has not been<\/p>\n
         commenced.     I have taken over<\/p>\n
         the charge of Kundara Police<\/p>\n
         Station         on      9.4.2010<\/p>\n
         consequent to the transfer of<\/p>\n
         my      predecessor.     It   is<\/p>\n
         submitted that all grievances<\/p>\n
         of     the  petitioner   can  be<\/p>\n
         redressed      by    me    after<\/p>\n
         conducting               further<\/p>\n
         investigation.”<\/p><\/blockquote>\n
      2.     On hearing the learned counsel appearing<\/p>\n
for    the    petitioner   and  the  learned Government<\/p>\n
pleader and going through the records including the<\/p>\n
statement filed by the Sub Inspector of Police, it<\/p>\n
is clear that there was no proper investigation. It<\/p>\n
is strange that        some of the accused were deleted<\/p>\n

without conducting an effective investigation.     In<\/p>\n
such     circumstances,   Sub  Inspector  of  Police,<\/p>\n
Kundara Police Station, the Investigating Officer<\/p>\n
is     to     be  directed  to   conduct  a   further<\/p>\n
investigation with the approval of the concerned<\/p>\n
Magistrate as provided under section 173(8) of the<\/p>\n
Code of Criminal Procedure.\n<\/p>\n
      Petition is allowed.   Sub Inspector of Police,<\/p>\n
Kundara       is  directed  to   conduct  a   further<\/p>\n
investigation     under  section 173(8)  of  Code  of<\/p>\n
Criminal Procedure on seeking formal permission of<\/p>\n
the    learned    Magistrate and  conduct  a  proper,<\/p>\n
effective and exhaustive investigation     and submit<\/p>\n
a report as provided under section 173(8) of Code<\/p>\n
of     Criminal    Procedure  before   the  concerned<\/p>\n
