TRIBHUWAN SAH @ TRIBHUWAN PRASAD GUPTA, SON OF\n           CHANDRIKA SAH\n        BOTH RESIDENTS OF VILLAGE MAHUA MUKUNDPUR, P.S.- MAHUA,\n        DISTRICT- VAISHALI\n                                             Versus\n                                   THE STATE OF BIHAR\n        For the petitioners     : Mr. Prahlad Kumar Bhagat, Advocate.\n        For the State           : Mr. Jharkhandi Upadhyay, APP\n                                           -----------\n<\/pre>\n<p>2   25.10.2010           Heard learned counsel for the petitioners and the State.<\/p>\n<p>                         Petitioners question the legality and propriety of order<\/p>\n<p>                 dated 13.6.2007 passed in Mahua P.S. case no. 112\/04 passed<\/p>\n<p>                 by learned Judicial Magistrate, 1st Class, Hajipur whereby on<\/p>\n<p>                 consideration of the materials filed along with the police paper, a<\/p>\n<p>                 prima facie case has been found to have been made out and<\/p>\n<p>                 accordingly, cognizance has been taken under Sections 147,<\/p>\n<p>                 149, 337, 353, 435 and 338 of the Indian Penal Code.<\/p>\n<p>                         While assailing the order, it is submitted that higher<\/p>\n<p>                 police officers have found that the petitioners had no hands in the<\/p>\n<p>                 aforesaid occurrence as they were not present at the place of<\/p>\n<p>                 occurrence. It is stated that one of the petitioners was admitted in<\/p>\n<p>                 the hospital whereas the another petitioner was away from the<\/p>\n<p>                 place of occurrence.\n<\/p>\n<p>                         I am afraid on this counts the order can be challenged.<\/p>\n<p>                 Learned Magistrate has referred to different paragraphs of the<\/p>\n<p>                 case diary in order to come to a conclusion that there is\/are<\/p>\n<p>                 material in the police papers which prima facie make out a case<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>      against the accused persons.\n<\/p>\n<p>               Considering the confines of jurisdiction invoked by the<\/p>\n<p>      learned Magistrate, I do not find any illegality in the order.<\/p>\n<p>               The application has no merit. It is accordingly dismissed.<\/p>\n<p>                              ( Kishore K.
