It will<br \/>\n        resolve the dispute in the Original Petitions.\n<\/p>\n<p>        \t2.  The issue  is  whether  the  first  appellant<br \/>\n        ought  to  have appointed the second respondent as Higher<br \/>\n        Secondary School Teacher (English)  against  the  vacancy<br \/>\n        earmarked for inservice candidates on commencement of the<br \/>\n        academic  year  1999-2000  during which five vacancies of<br \/>\n        such teachers had been filled up.\n<\/p>\n<p>        \t3.  As per Exhibit P2 order prescribing method of<br \/>\n        appointment, twenty-five per cent of the vacancies  shall<br \/>\n        be  earmarked  for  qualified  High School Assistants and<br \/>\n        Primary School Teachers  working  under  the  management.<br \/>\n        The   first  appellant  is  the  Manager  of  the  School<br \/>\n        concerned.  The Higher Secondary course  was  started  in<br \/>\n        the year   1998.      During  that  year  12  posts  were<br \/>\n        sanctioned.  The first appellant did not fill up all  the<br \/>\n        vacancies.   Post  of  Higher  Secondary  School  Teacher<br \/>\n        (Hindi) was kept vacant.  Even though the  petitioner  in<br \/>\n        O.P.No.12706  of  2003  was in service as UPSA(Hindi), he<br \/>\n        was not promoted against that vacancy.  He claims that he<br \/>\n        was  qualified  during  the  year  1998-99  even  on  the<br \/>\n        strength  of Exhibit P2 Government Order in that Original<br \/>\n        Petition.\n<\/p>\n<p>        \t4.   During  the  year  1999-2000 out of the five<br \/>\n        vacancies to  be  filled  up,  one  was  that  of  Higher<br \/>\n        Secondary School Teacher (English) and another was Higher<br \/>\n        Secondary  School  Teacher  (Hindi) which was vacant from<br \/>\n        the previous year onwards.  The first appellant preferred<br \/>\n        the petitioner in O.P.No.12706 of 2003, a  Hindi  Teacher<br \/>\n        in  the  quota for inservice candidates and filled up the<br \/>\n        other posts including that of English Teacher  by  direct<br \/>\n        recruitment.   Against  the  post  of English Teacher the<br \/>\n        second appellant was appointed.  This was objected to  by<br \/>\n        the  second respondent in the Writ Appeal contending that<br \/>\n        she, being senior to the petitioner  in  O.P.No.12706  of<br \/>\n        2003,  ought  to  have  been  preferred  for  appointment<br \/>\n        against the post of English Teacher setting it  apart  to<br \/>\n        inservice candidates.     It  was  filled  up  by  direct<br \/>\n        recruitment.  In other words, it is contended  that  when<br \/>\n        steps  for filling up five vacancies were taken up during<br \/>\n        the year 1999-2000, 25% thereof should  have  been  given<br \/>\n        for  inservice  candidates  and  while  considering  such<br \/>\n        incumbents the person with lengthier  service  among  the<br \/>\n        aspirants  should  have  been  considered  first  and the<br \/>\n        remaining  75%  should  have  been  reserved  for  direct<br \/>\n        recruitment.  In such a situation, the second respondent,<br \/>\n        who had lengthier service ought to have been appointed as<br \/>\n        Higher  Secondary  School  Teacher (English), rather than<br \/>\n        the petitioner  in  O.P.No.12706  of  2003  appointed  as<br \/>\n        Higher Secondary  School Teacher (Hindi).  The department<br \/>\n        found this contention in favour of the second  respondent<br \/>\n        as  is  seen  from  Exhibit P7, of course, on a different<br \/>\n        reason based on an interim order passed  by  the  Supreme<br \/>\n        Court on 7.12.1999.  But the facts remain that the junior<br \/>\n        hand,  namely, the petitioner in O.P.No.12706 of 2003 was<br \/>\n        preferred for appointment from among existing teachers in<br \/>\n        the school on  2.8.1999  and  the  second  appellant  was<br \/>\n        directly  appointed  as  English Teacher with effect from<br \/>\n        2.8.1999.   Therefore,  the  position  of  the  rules  or<br \/>\n        orders,  obtainable  as  on that date, ought to have been<br \/>\n        considered.\n<\/p>\n<p>        \t5.  Exhibit P7 was challenged on  that  count  by<br \/>\n        the second  respondent.  Even if the position on 2.8.1999<br \/>\n        or 28.9.1999 is taken  note  of,  no  order  is  produced<br \/>\n        before us  to  show that the petitioner in O.P.No.  12706<br \/>\n        of 2003 was having  lengthier  service  than  the  second<br \/>\n        respondent.   On  the  other hand it is admitted that the<br \/>\n        second  respondent  is,  in  any  way,  senior   to   the<br \/>\n        petitioner in  O.P.No.12706 of 2003.  Therefore, he ought<br \/>\n        to have been considered for the post  for  which  he  was<br \/>\n        qualified  rather  than preferring a junior hand like the<br \/>\n        petitioner in O.P.No.12706 of 2003.\n<\/p>\n<p>        \t6.   At  this juncture, it is submitted on behalf<br \/>\n        of the first appellant that Exhibit P2 order  prescribing<br \/>\n        the   ratio   of   25:75  between  promotion  and  direct<br \/>\n        recruitment does not stipulate that  the  Manager  should<br \/>\n        fill  up  first  the  post  to  which senior incumbent is<br \/>\n        entitled.   When  there  is  no  such   stipulation   for<br \/>\n        regulating appointment or promotion based on seniority in<br \/>\n        Exhibit  P2  or in any other order, the Manager being the<br \/>\n        authority invested with power  to  make  appointment  and<br \/>\n        promotion  of  his  own staff, has to follow a reasonable<br \/>\n        method.  The reasonable method is  that  when  there  are<br \/>\n        several teachers belonging to different subjects entitled<br \/>\n        for  consideration to few vacancies, those posts to which<br \/>\n        senior incumbents are to be considered shall be set apart<br \/>\n        for  quota  of  inservice  candidates,  so  that   senior<br \/>\n        incumbent  shall not be superseded by a junior incumbent.<br \/>\n        Otherwise it will be arbitrary and discriminatory.\n<\/p>\n<p>        \t7.  Admittedly, there were five vacancies  to  be<br \/>\n        filled up  during  the year 1999-2000.  One shall be from<br \/>\n        among  the  existing  teachers  on  any  count  following<br \/>\n        Exhibit P2.   The eligible persons at that point of time,<br \/>\n        were  the  second  respondent  and  the   petitioner   in<br \/>\n        O.P.No.12706 of 2003.    The  former  was senior.  He was<br \/>\n        qualified for the post of  English  Teacher.    That  was<br \/>\n        available.  The  latter was junior.  He was qualified for<br \/>\n        the post of Hindi Teacher.  That was also available.  But<br \/>\n        the Manager could prefer only one incumbent following the<br \/>\n        reasonable method.      Senior   shall   be    preferred,<br \/>\n        ordinarily.   No  extraordinary situation is pointed out.<br \/>\n        So  the  Manager  ought  to  have  appointed  the  second<br \/>\n        respondent.\n<\/p>\n<p>        \t8.   At  this  juncture,  the  contention  of the<br \/>\n        petitioner in O.P.No.12706 of 2003,  the  Hindi  teacher,<br \/>\n        that  he  was  even qualified during the year 1998-99 for<br \/>\n        appointment to the post of Hindi Teacher which  was  kept<br \/>\n        vacant is  to  be  considered.  If he was eligible during<br \/>\n        the year 1998-99, necessarily, there would have  been  no<br \/>\n        vacancy in the year 1999-2000 for appointing an inservice<br \/>\n        candidate including the second respondent.  The averments<br \/>\n        in  O.P.No.12706  of 2003 is that he was qualified in the<br \/>\n        year 1998-99, as evidenced by Exhibit P2 marked  therein.<br \/>\n        It  is  only  a  proceedings  of  the  Director of Higher<br \/>\n        Secondary Education.  He cannot  prescribe  qualification<br \/>\n        for a post.    It  has  to  be done by Government.  It is<br \/>\n        clear from Exhibit  P2  that  the  circular  referred  to<br \/>\n        therein  applies  only  to  appointments  in departmental<br \/>\n        Schools.  Admittedly, the school concerned  is  an  aided<br \/>\n        Higher Secondary  School.    So Exhibit P2 cannot advance<br \/>\n        the case of the petitioner any more.  On the other  hand,<br \/>\n        we see from Exhibit R3(a) produced along with the counter<br \/>\n        affidavit of the third respondent, who is none other than<br \/>\n        the second respondent in the other Original Petition that<br \/>\n        the  petitioner  therein became qualified for appointment<br \/>\n        as Higher Secondary School Teacher only on  the  strength<br \/>\n        of Exhibit  R3(a)  order  dated  20.9.1999.    He did not<br \/>\n        possess B.Ed.   in  Hindi.    He  had  passed  only   LTT<br \/>\n        qualification.     It   is   prescribed   as   sufficient<br \/>\n        qualification for the post  of  Higher  Secondary  School<br \/>\n        Teacher only  as per Exhibit R3(a) dated 20.9.1999.  That<br \/>\n        means,  during  the  year  1998-99  the   petitioner   in<br \/>\n        O.P.No.12706  of 2003 was not qualified to be promoted as<br \/>\n        High Secondary School Teacher (Hindi) as he did not  have<br \/>\n        B.Ed.  Degree.    That  petitioner  was  appointed by the<br \/>\n        Manager as H.S.S.  Teacher(Hindi) only with  effect  from<br \/>\n        28.9.1999  after  he  became qualified only just ten days<br \/>\n        ago as per Exhibit R3(a) dated 20.9.1999.    Even  before<br \/>\n        that,  a  qualified  hand  like the second respondent was<br \/>\n        available for being appointed as English Teacher.  But in<br \/>\n        the  existing  vacant  post  the  second  appellant   was<br \/>\n        appointed on  2.8.1999.    At that time the petitioner in<br \/>\n        O.P.No.12706  of  2003  was  not   even   qualified   for<br \/>\n        promotion.    The  post  reserved  to  be  filled  up  by<br \/>\n        inservice candidates ought to  have  been  filled  up  by<br \/>\n        appointing  the second respondent on 2.8.1999 itself when<br \/>\n        an English hand has been appointed.  Therefore,  we  find<br \/>\n        that  there is nothing for interference with the impugned<br \/>\n        judgment in W.A.No.1057 of 2002 and  in  O.P.No.12706  of<br \/>\n        2003.   In other words, the second respondent in the Writ<br \/>\n        Appeal will have to  be  taken  as  duly  appointed,  for<br \/>\n        purpose   of  seniority,  on  a  date  earlier  than  the<br \/>\n        appointment of the junior incumbent,  the  petitioner  in<br \/>\n        O.P.No.12706  of  2003, who was continued at the volition<br \/>\n        of the Manager as Higher Secondary School Teacher, though<br \/>\n        on  promotion  against  a  vacancy  reserved  for  direct<br \/>\n        recruitment,  which  is  not  impugned  by  anybody else.<br \/>\n        Therefore, W.A.No.1057 of 2002 and O.P.No.12706  of  2003<br \/>\n        stand dismissed.\n<\/p>\n<p>        \t9.   Necessarily, when this declaration is there,<br \/>\n        O.P.No.7823 of 2003 filed by the second respondent in the<br \/>\n        Writ Appeal stands allowed to the limited extent that she<br \/>\n        shall  be  recorded  as  senior  to  the  petitioner   in<br \/>\n        O.P.No.12706  of  2003  for  the purpose of seniority and<br \/>\n        other benefits except arrears of salary.
