L. Pandya, learned APP waives service of Rule on behalf<br \/>\nof respondent.\n<\/p>\n<p>2.\tThis<br \/>\napplication has been preferred under Section-439 of the Code of<br \/>\nCriminal Procedure, in connection with the<br \/>\noffence being CR No. I-64 of 2011 registered with Rajghad<br \/>\nPolice Station, Panchmahal for the offences u\/s. 363, 366 and 376 of<br \/>\nthe Indian Penal Code.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate for the applicant has contended that in the birth<br \/>\ncertificate, date of birth of prosecutrix is shown as 10\/11\/1995 and<br \/>\nshe has cleared 12th standard examination.  He has<br \/>\ncontended that the certificate showing the date of birth of the<br \/>\nprosecutrix creates some doubt.  He has also contended that there was<br \/>\nlove affair between the applicant and the prosecutrix since long.<br \/>\nThere is delay of 10 days in filing complaint and said delay is not<br \/>\nexplained by the complainant.  He has further contended that this is<br \/>\na clear case of consent and further he has stated that in this case<br \/>\ncharge sheet is filed and therefore, present applicant is required to<br \/>\nbe released on bail.\n<\/p>\n<p>5.\tLearned<br \/>\nAPP Mr. K. L. Pandya has vehemently opposed this application. He has<br \/>\nread the papers and contended that age of prosecutrix is below 16<br \/>\nyears and therefore, consent cannot be considered for proving the<br \/>\napplicant innocent.  Even he has read the statement of prosecutrix.<br \/>\nThe offence under Section-376 of the Indian Penal Code is proved and<br \/>\nprima facie it is established that looking to the question of safety<br \/>\nof society also, such application cannot be entertained.\n<\/p>\n<p>6.\tHeard<br \/>\nlearned advocate for both the parties.  From the perusal of the<br \/>\npapers, it is established that prosecutrix is below 16 years and<br \/>\ntherefore, consent cannot be considered.  Even from the statement of<br \/>\nthe prosecutrix also, the case against the applicant is established<br \/>\nand therefore bail cannot be granted.  Hence, looking to the facts<br \/>\nand circumstances of the case, as stated above, this Court is not<br \/>\ninclined to grant bail to the applicant.  The application of the<br \/>\napplicant accused deserves to be dismissed.  hence, the application<br \/>\nis dismissed.\n<\/p>\n<p>7.\tRule<br \/>\nis discharged.
