SHARIF ANSARI\n                                     Versus\n                            THE STATE OF BIHAR\n                                    -----------\n<\/pre>\n<p>04   21.01.2011                 Both the above stated Cr. Misc. Cases have arisen out of<\/p>\n<p>                    Mohammadpur P.S. Case No. 67 of 2010 registered under Sections<\/p>\n<p>                    395\/120 (B) of the Indian Penal Code and, accordingly, both the above<\/p>\n<p>                    stated Cr. Misc. Cases are being disposed of by this common order.<\/p>\n<p>                                    Heard learned counsel for the petitioners as well as<\/p>\n<p>                    learned Public Prosecutor for the State.\n<\/p>\n<p>                                    Petitioners are not named in the First Information Report<\/p>\n<p>                    but, in course of investigation, it came to light that petitioners had<\/p>\n<p>                    conspired along with one Hakimullah Ansari in committing the alleged<\/p>\n<p>                    crime and subsequently, it is stated that the looted cash was recovered<\/p>\n<p>                    from the houses of the petitioners.\n<\/p>\n<p>                                    Learned counsel for the petitioners submits that there is<\/p>\n<p>                    nothing on the entire case diary to show this fact that the recovered cash<\/p>\n<p>                    was looted property.\n<\/p>\n<p>                                    On the other hand, learned counsel appearing for the<\/p>\n<p>                    informant, submits that the above stated looted cash had been recovered<\/p>\n<p>                    on the basis of confessional statement, made by petitioner in Cr. Misc.<\/p>\n<p>                    No. 45021 of 2010. He further submits that in course of investigation, it<\/p>\n<p>                    came to light that the petitioners were in constant touch on mobile with<\/p>\n<p>                    the above stated co-accused Hakimullah Ansari.<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>                         Admittedly, petitioners do not have any criminal<\/p>\n<p>          antecedent, which is evident from the report of Superintendent of<\/p>\n<p>          Police, Gopalganj.\n<\/p>\n<p>                         Considering the aforesaid facts and circumstances as<\/p>\n<p>          well as submissions of the parties above named petitioners are directed<\/p>\n<p>          to be released on bail on furnishing bail bonds of Rs. 10,000\/- (Ten<\/p>\n<p>          Thousand) with two sureties of the like amount each to the satisfaction<\/p>\n<p>          of Chief Judicial Magistrate, Gopalganj in connection with above stated<\/p>\n<p>          Mohammadpur P.S.
