M. SAHAI)<\/p>\n<p>1.\t\tWe<br \/>\nhave heard Mr.N.J.Shah, learned Assistant Government Pleader for the<br \/>\nappellants. This Letters Patent Appeal has been filed challenging the<br \/>\njudgment of the learned Single Judge dated 3rd September, 2007 passed<br \/>\nin Special Civil Application No. 22491 of 2007. The learned Single<br \/>\nJudge in paragraphs  10 and 11  of his judgment has issued the<br \/>\nfollowing directions:\n<\/p>\n<p>&#8220;10.\n<\/p>\n<p>In view of this background, it is directed to the respondents to<br \/>\nreconsider case of the petitioner for compassionate appointment on<br \/>\nthe basis of policy dated 10th March, 2000\/7th September, 2002 which<br \/>\nwas prevailing at the relevant time when father of the petitioner<br \/>\nexpired and also to consider the aforesaid two decisions of the Apex<br \/>\nCourt and then to pass appropriate reasoned orders in accordance with<br \/>\nlaw within three months from the date of receipt of copy of this<br \/>\norder and to communicate their decision to the petitioner immediately<br \/>\nthereafter.\n<\/p>\n<p>11.<br \/>\n With these observations and directions, this petition is disposed of<br \/>\nat this stage without expressing any opinion on merits of the matter<br \/>\nand with a liberty in favour of the petitioner to challenge the<br \/>\norders that may be made by respondents before the appropriate forum<br \/>\nin accordance with law if the same are adverse to the petitioner<br \/>\nDirect service is permitted.&#8221;\n<\/p>\n<p>2.\t\tSince<br \/>\nonly direction has been issued to the respondents to examine<br \/>\ngrievances of the petitioner and for considering the claim of the<br \/>\npetitioner for compassionate appointment, we are not inclined to<br \/>\ninterfere with the matter at this stage. We do not find any<br \/>\nmerit in this Letters Patent Appeal.
