It is the case of the petitioner that the petitioner was<br \/>\n\tserving as Senior Clerk in the respondent-Corporation. The<br \/>\n\tpetitioner was issued a charge-sheet dated 12th December<br \/>\n\t1996 for holding a departmental inquiry against him. As a result of<br \/>\n\tthe same, the petitioner is reduced in pay-scale, as also the<br \/>\n\tsuspension period is ordered to be treated on duty for the purpose<br \/>\n\tof pension and gratuity only. The petitioner preferred an appeal<br \/>\n\tbefore the Appellate Authority, which ultimately came to be<br \/>\n\trejected. Hence, the present petition.\n<\/p>\n<p>\tMr.I.A.\n<\/p>\n<p>\tSupehia, learned counsel appearing for the petitioner, has submitted<br \/>\n\tat length and thereafter, restricted his arguments only on the point<br \/>\n\tof disproportionate penalty and has submitted that when all the<br \/>\n\tcharges against the petitioner have not been proved in toto, the<br \/>\n\tpetitioner ought not to have been imposed such a grave punishment.\n<\/p>\n<p>\tHaving<br \/>\n\tconsidered the rival contentions raised by the learned advocates for<br \/>\n\tthe respective parties and the documents on record as well as the<br \/>\n\taverments made in the petition, it transpires that the petitioner<br \/>\n\thas been issued a charge-sheet dated 12th December 1996<br \/>\n\tcontaining four charges. It is stated in the charge-sheet that if<br \/>\n\tany of the charges are proved against the petitioner, he would be<br \/>\n\timposed punishment under Section 56(2) of the Bombay Provincial<br \/>\n\tMunicipal Corporation Act, 1949 (hereinafter referred to as  the<br \/>\n\tAct ). It is pertinent to note that the Departmental Inquiry was<br \/>\n\tconducted against the petitioner, wherein the Inquiry Officer has<br \/>\n\theld one major charge against the petitioner to be partly proved and<br \/>\n\tother three charges as proved. The petitioner was issued a show<br \/>\n\tcause notice and thereafter, vide impugned order dated 19th<br \/>\n\tMay 1999, the petitioner has been imposed the penalty by reduction<br \/>\n\tin his pay-scale from Rs.5500-9000 to Rs.4000-6000.\n<\/p>\n<p>\tIt<br \/>\n\tis pertinent to note that the said Section 56(2) of the Act does not<br \/>\n\tmake any distinction between the major and minor penalties. In<br \/>\n\tabsence of any specific mention about the penalty in the<br \/>\n\tcharge-sheet as well as the show cause notice, the penalty of<br \/>\n\treduction in pay-scale cannot be imposed by the<br \/>\n\trespondent-authority.\n<\/p>\n<p>\tIt<br \/>\n\tis pertinent to note that out of the total four charges, the Inquiry<br \/>\n\tOfficer has found the Charge No.1, which is the major charge, as<br \/>\n\tpartly proved. Thus, when the major charge against the petitioner<br \/>\n\thas been partly proved, the imposition of such a harsh punishment<br \/>\n\tupon the petitioner is unjust and improper. The penalty imposed upon<br \/>\n\tthe petitioner is disproportionate and excessive. The<br \/>\n\trespondent-authority has failed to take into consideration that no<br \/>\n\tfinancial loss has been caused to the respondent-Corporation on<br \/>\n\taccount of the conduct of the petitioner. Therefore, the imposition<br \/>\n\tof such a harsh punishment of reduction in pay-scale would result<br \/>\n\tinto miscarriage of justice and would render a loss of at least<br \/>\n\tRs.1500\/- per month to the petitioner in the basic pay.\n<\/p>\n<p>\tSo<br \/>\n\tfar as treating the period of suspension on duty for the purpose of<br \/>\n\tpension and gratuity is concerned, as per Rule 152 of the Bombay<br \/>\n\tCivil Services Rules, the petitioner was required to be heard before<br \/>\n\tpassing such an order about treating the suspension period. No such<br \/>\n\topportunity has been afforded to the petitioner. Therefore, on the<br \/>\n\tground of principles of natural justice also, such a punishment<br \/>\n\tcould not have been imposed upon the petitioner.\n<\/p>\n<p>\tIn<br \/>\n\tview of aforesaid, I am of the opinion that the respondent-authority<br \/>\n\thas failed to take into consideration the pros and cons of the<br \/>\n\tmatter and imposed such a harsh penalty upon the petitioner, which<br \/>\n\tis confirmed by the Appellate Authority without appreciating the<br \/>\n\tfacts and circumstances of the case and documents on record. Thus, I<br \/>\n\thold that the impugned order imposing such a harsh punishment upon<br \/>\n\tthe petitioner is bad in the eye of law. However, so far as the<br \/>\n\tcharges proved against the petitioner are concerned, I am of the<br \/>\n\topinion that the penalty of stoppage of five increments with future<br \/>\n\teffect would suffice the purpose. Hence, the present petition is<br \/>\n\trequired to be partly allowed.\n<\/p>\n<p>\tFor<br \/>\n\tthe foregoing reasons, the present petition is hereby partly<br \/>\n\tallowed. The impugned order dated 19th May 1999 passed by<br \/>\n\tthe respondent-authority as well as the order passed by the<br \/>\n\tAppellate Authority are modified and substituted to the effect that<br \/>\n\tthe petitioner is imposed penalty of stoppage of five increments<br \/>\n\twith future effect. The respondent-authority is directed to pay the<br \/>\n\tamount of arrears as well as allowances and towards other<br \/>\n\tconsequential and incidental benefits  to the heirs and legal<br \/>\n\trepresentatives of the petitioner who are brought on record after<br \/>\n\tdue verification. Rule is made absolute to the aforesaid extent.
