In<br \/>\npursuance to the said impugned order, the petitioner is detained in<br \/>\nGodhra Jail.\n<\/p>\n<p>3.\tFrom<br \/>\nthe grounds of detention, it appears that three offences being<br \/>\nprohibition CR Nos. 83 of 2008, 118 of 2009 and 148 of 2009 have been<br \/>\nregistered against the petitioner-detenu at Pradyumnanagar Police<br \/>\nStation, Rajkot City under the provisions of Sections 66(1)(B), 65AE,<br \/>\n116 and 81 of the Bombay Prohibition Act, wherein a a total quantity<br \/>\nof 179 bottles of different brands of foreign liquor were found from<br \/>\nthe possession of the petitioner.  On the basis of the registration<br \/>\nof these cases, the detaining authority held that the present detenu<br \/>\nwas carrying on activities of selling Liquor which is harmful to the<br \/>\nhealth of the public. It is held by the detaining authority that as<br \/>\nthe detenu is indulged in illegal activities, it is required to<br \/>\nrestrain the detenu from carrying out further illegal activities,<br \/>\nI.e. selling of liquor. The detaining authority has placed reliance<br \/>\non the above registered offences and statements of unnamed witnesses.<br \/>\nIn the opinion of this Court, the activities of the detenu can, by no<br \/>\nstretch of imagination, be said to be disturbing the  public<br \/>\norder . It is seen from the grounds that a general statement that<br \/>\nhas been made by the detaining authority that consuming liquor is<br \/>\ninjurious to health. In fact, a perusal of the order passed by the<br \/>\ndetaining authority shows that the grounds which are mentioned in the<br \/>\norder are in reference to the situation of  law and order  and<br \/>\nnot  public order . Therefore, on this ground, the subjective<br \/>\nsatisfaction arrived at by the detaining authority is vitiated on<br \/>\naccount of non-application of mind and the impugned order, therefore,<br \/>\ndeserves to be quashed and set aside.\n<\/p>\n<p>4.\tExcept<br \/>\nthe statements of some anonymous witnesses, there is no material on<br \/>\nrecord which shows that the petitioner-detenu is carrying on<br \/>\nactivities of selling country made liquor which is harmful to the<br \/>\nhealth of the public. In the case of Ashokbhai Jivraj @ <a href=\"\/doc\/687998\/\">Jivabhai<br \/>\nSolanki v. Police Commissioner, Surat<\/a> [(2001 (1) GLH 393)], having<br \/>\nconsidered the decision of the Hon&#8217;ble Apex Court in the case of Ram<br \/>\nManohar Lohia v. State of Bihar (AIR 1966 SC 740),<br \/>\nthis Court held that the cases wherein the detention order passed on<br \/>\nthe basis of the statements of the witnesses falls under the<br \/>\nmaintenance of  law and order  and not  public order .\n<\/p>\n<p>5.\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing an<br \/>\norder of detention of a detenu, the detaining authority must come to<br \/>\na definite finding that there is  threat to the  public order<br \/>\nand it is very clear that the present case would not fall within the<br \/>\ncategory of threat to  public order . In that view of the matter,<br \/>\nwhen the order of detention has been passed by the detaining<br \/>\nauthority without having<br \/>\nadequate grounds for passing the said order, it cannot be sustained<br \/>\nand, therefore, it deserves to be quashed and set aside.\n<\/p>\n<p>6.\tIn<br \/>\nthe result, this petition is allowed. The impugned order of detention<br \/>\ndated 3.8.2009 passed by the respondent NO.2-Police Commissioner,<br \/>\nRajkot City is hereby quashed and set aside. The detenu is ordered to<br \/>\nbe set at liberty forthwith, if his presence is not required in any<br \/>\nother offence. Rule is made absolute accordingly.
