Justice C.K.ABDUL REHIM\n\n Dated :21\/12\/2010\n\n O R D E R\n                     C.K.ABDUL REHIM, J\n                ---------------------------------------\n                 W.P(C) No.37072 of 2010-H\n               ----------------------------------------\n        Dated this the 21st day of December, 2010.\n\n                        J U D G M E N T\n<\/pre>\n<p>     The writ petition is filed aggrieved by coercive steps<\/p>\n<p>initiated under the Securitization and Reconstruction of<\/p>\n<p>Financial Assets and Enforcement of Security Interest Act,<\/p>\n<p>2002 (SARFAESI Act). Consequent to default committed by<\/p>\n<p>the petitioner in re-payment of a housing loan availed from<\/p>\n<p>the respondent Bank steps were initiated against the<\/p>\n<p>immovable property which is the secured asset. Ext.P2 is<\/p>\n<p>the notice issued under Rule 8(1) of the Security Interest<\/p>\n<p>(Enforcement) Rules intimating steps contemplated under<\/p>\n<p>Section 13(4) of the Act. The petitioner submitted Ext.P3<\/p>\n<p>representation offering to clear the present dues and<\/p>\n<p>requesting   to permit        regularisation of the       account.<\/p>\n<p>According to the petitioner, the respondent Bank is<\/p>\n<p>proceeding with coercive steps without considering such<\/p>\n<p>request.   Hence the petitioner seeks interference of this<\/p>\n<p>Court.\n<\/p>\n<p><span class=\"hidden_text\">W.P(C) No.37072 of 2010-H     2<\/span><\/p>\n<p>     2.    Learned standing counsel appearing for the<\/p>\n<p>respondent Bank submitted that the loan in question was<\/p>\n<p>availed in the year 2009 to the tune of Rs.8 lakhs and that<\/p>\n<p>the petitioner had defaulted regular payments of monthly<\/p>\n<p>instalments. It is further submitted that the Bank had never<\/p>\n<p>received any representation as that of Ext.P3.<\/p>\n<p>     3.    Considering the fact that the petitioner has got<\/p>\n<p>effective remedy under the statute, it is not proper and<\/p>\n<p>justified for this Court to interfere with the proceedings.<\/p>\n<p>However, learned counsel for the petitioner submitted that<\/p>\n<p>the re-payment period of the loan is for 15 years and that<\/p>\n<p>the petitioner is not intending to pursue any such statutory<\/p>\n<p>remedies and that he is relinquishing all challenges against<\/p>\n<p>the proceedings initiated. On the other hand, the limited<\/p>\n<p>prayer is only to permit the petitioner to regularise the<\/p>\n<p>account on the basis of an offer that he will pay off the<\/p>\n<p>arrears within a short time.\n<\/p>\n<p>     4.    Eventhough    interference  on    merits  is  not<\/p>\n<p>desirable, I am of the view that indulgence can be shown in<\/p>\n<p><span class=\"hidden_text\">W.P(C) No.37072 of 2010-H    3<\/span><\/p>\n<p>permitting the petitioner to regularise the account, if he is<\/p>\n<p>relinquishing all challenges.\n<\/p>\n<p>     5.   Accordingly, the writ petition is disposed of<\/p>\n<p>directing the respondent Bank to keep in abeyance further<\/p>\n<p>steps of recovery pursuant to Ext.P2 notice provided the<\/p>\n<p>petitioner remits the entire amount in default (defaulted<\/p>\n<p>instalments along with interest and expenses if any due) in<\/p>\n<p>2 (two) equal monthly instalments falling due on or before<\/p>\n<p>15.1.2011 and on or before 15.2.2011. The petitioner shall<\/p>\n<p>also make payment of regular instalments due for the<\/p>\n<p>months of January and February 2011 along with above said<\/p>\n<p>payments.\n<\/p>\n<p>     6.   If payments of defaulted amounts is regularised as<\/p>\n<p>directed above, the respondents shall permit the petitioner<\/p>\n<p>to continue payment of the future instalments in terms of<\/p>\n<p>the original schedule.\n<\/p>\n<p>     7.   It is made clear that on the event of default in<\/p>\n<p>payment of any of the instalments the respondent will be<\/p>\n<p>free to proceed with further steps on the basis of Ext.P2<\/p>\n<p><span class=\"hidden_text\">W.P(C) No.37072 of 2010-H   4<\/span><\/p>\n<p>notice.
