No.21707 of 2009\n              ---------------------------------\n              Dated, this the 3rd day of August, 2009\n\n                           J U D G M E N T\n<\/pre>\n<p>      The petitioner is a member of the 1st respondent Bank.<\/p>\n<p>Election to the Board of Directors of the 1st respondent Bank was<\/p>\n<p>notified as per Ext.P1 and the election is scheduled to take place on<\/p>\n<p>08\/08\/2009.       The petitioner submits that in terms of the<\/p>\n<p>notification, a preliminary voters list was published and the final<\/p>\n<p>voters list was published on 20\/07\/2009.\n<\/p>\n<p>      2.    The petitioner states that in the preliminary voters list,<\/p>\n<p>copy of which was served on him, his name was included and on<\/p>\n<p>that basis, he filed his nomination on 27\/07\/2009. However, by<\/p>\n<p>Ext.P6 dated 28\/07\/2009, the Returning Officer informed him that<\/p>\n<p>his nomination is rejected as his name and number were not<\/p>\n<p>included in the final voters list published on 20\/07\/2009.<\/p>\n<p>Immediately on the next day itself, the 1st respondent Bank issued<\/p>\n<p>Ext.P5 to the petitioner informing that omission to include in the<\/p>\n<p>final voters list published on 20\/07\/2009 came to the notice of the<\/p>\n<p>WP(C) No.21707\/2009<br \/>\n<span class=\"hidden_text\">                                  -2-<\/span><\/p>\n<p>Bank only on 28\/07\/2009, and that the Bank has already intimated<\/p>\n<p>the omission to the Returning Officer. In this communication, the<\/p>\n<p>Bank has also stated that the omission is happened as the work of<\/p>\n<p>preparation of the final voters list was outsourced, and that the<\/p>\n<p>petitioner has all the qualifications to contest in the election.<\/p>\n<p>Despite Ext.P5, his nomination was not accepted, and therefore, the<\/p>\n<p>writ petition is filed.\n<\/p>\n<p>      3.    Instructions  have   been   obtained   by   the  learned<\/p>\n<p>Government Pleader, who also confirms that it was only on account<\/p>\n<p>of an omission on the part of the 1st respondent that the petitioner&#8217;s<\/p>\n<p>name happened to be not included in the final voters list.<\/p>\n<p>Admittedly, the omission was happened at the hands of the 1st<\/p>\n<p>respondent, and not for any reason, which is attributable to the<\/p>\n<p>petitioner or to the Returning Officer.\n<\/p>\n<p>      4.    Having regard to these facts, the petitioner, as a<\/p>\n<p>member, is entitled to have submitted his nomination and it is for<\/p>\n<p>the Returning Officer to ensure and satisfy that he is qualified to<\/p>\n<p>contest in the election. In the peculiar facts of the case as noticed<\/p>\n<p>above, I direct the Returning Officer to accept nomination of the<\/p>\n<p>WP(C) No.21707\/2009<br \/>\n<span class=\"hidden_text\">                                  -3-<\/span><\/p>\n<p>petitioner and verify whether he is eligible to be a candidate and if<\/p>\n<p>so, permit him to be a candidate in the election.<\/p>\n<p>      5.
