DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 06\/09\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tHeard<br \/>\nlearned counsel for the parties.\n<\/p>\n<p>\tBasically,<br \/>\nit is submitted by learned advocates for the petitioners that, in<br \/>\nabsence of any policy, guidelines framed by the State under the<br \/>\nstatute, mass recruitment of Vidhya Shayaks is undertaken contrary to<br \/>\nthe law laid down by the Apex Court in the cases of [i] <a href=\"\/doc\/762690\/\">Ritesh R.<br \/>\nShah v. Dr. Y.L.Yamul &amp; Ors.<\/a> [AIR 1996 SC 1379] and [ii] <a href=\"\/doc\/325761\/\">Union of<br \/>\nIndia v. Ramesh Ram<\/a> [2010 (7) SCC 234].\n<\/p>\n<p>\tEarlier,<br \/>\nvide order dated 26.08.2011 learned Single Judge has recorded brief<br \/>\ncontentions made by learned counsel for the parties. The matter<br \/>\ndeserves consideration and to be heard finally.\n<\/p>\n<p>\tIssue<br \/>\nrule returnable on 29.09.2011.\n<\/p>\n<p>\tIn<br \/>\nthe meanwhile, respondent authorities are directed to keep one post<br \/>\nof Vidhya Sahayak vacant pursuant to the recruitment drive undertaken<br \/>\nby the respondent authorities as per the advertisement dated<br \/>\n15.07.2011.\n<\/p>\n<p>[Anant<br \/>\nS.
