BAROON\n                    DISTRICT AURANGABAD.\n                                        ...Petitioner\n                                Versus\n                    STATE OF BIHAR\n                                        ...Opposite party\n                                          -----------\n<\/pre>\n<p>03.   16.08.2010               Rule confined to the question of sentence only.<\/p>\n<p>                               Learned APP waives service of notice on behalf of<\/p>\n<p>                   the State<\/p>\n<p>                               With the consent of the parties, the application is<\/p>\n<p>                   now being disposed of.\n<\/p>\n<p>                               For an occurrence that had taken place on<\/p>\n<p>                   15.11.1998, the petitioner was charge under sections 323 and<\/p>\n<p>                   325 IPC. Allegation against the petitioner is that when the<\/p>\n<p>                   informant saw 2-3 buffallows grazing his crops, he tried to drive<\/p>\n<p>                   them away. This was protested by the accuseds whereafter it is<\/p>\n<p>                   alleged that he was assaulted by means of Lathi on different<\/p>\n<p>                   parts of his body (not on the vital part). The prosecution in order<\/p>\n<p>                   to prove charge(s) examined        five witnesses. P.W.1 is the<\/p>\n<p>                   informant who is said to have received injury. P.W.5 is the<\/p>\n<p>                   doctor who examined        him of his injury. Considering the<\/p>\n<p>                   materials on record including the evidence of the informant and<\/p>\n<p>                   the doctor (P.W.5), learned trial court has found that the charge<\/p>\n<p>                   under section 323 IPC has been proved beyond shadow of<\/p>\n<p>                   reasonable doubts. He was accordingly convicted. So far as<\/p>\n<p>                   section 325 IPC is concerned, the petitioner was acquitted of the<br \/>\n<span class=\"hidden_text\">                       2<\/span><\/p>\n<p>charge. Learned trial court on a consideration of the fact that he<\/p>\n<p>was aged about 38 years and was not previously convicted and<\/p>\n<p>the fact that the occurrence had taken place over trivial issue,<\/p>\n<p>sentenced him to undergo R.I. for six months.<\/p>\n<p>            Being aggrieved by the aforesaid        judgment and<\/p>\n<p>order of conviction, the petitioner preferred criminal appeal<\/p>\n<p>being Cr.Appeal No.04\/2003\/53\/2009 in the Court of            Addl.<\/p>\n<p>Sessions Judge IV, Aurangabad. The learned lower appellate<\/p>\n<p>court re-appraised the evidence and came to the conclusion that<\/p>\n<p>findings of guilt recorded by learned trial court do not warrant<\/p>\n<p>any interference. Appeal was, thus, dismissed.<\/p>\n<p>              Learned counsel for the petitioner submits that<\/p>\n<p>admittedly the occurrence had taken place over a trivial issue. It<\/p>\n<p>is stated that both parties are of the same village and are residing<\/p>\n<p>adjacent to each other. It is next submitted that for about five<\/p>\n<p>years the petitioner had to undergo the ordeal of trial which in<\/p>\n<p>itself is a punishment as fighting litigation for a long time<\/p>\n<p>definitely tells upon the mental and economical condition of the<\/p>\n<p>litigant. It is thus contended that the petitioner deserves lessor<\/p>\n<p>punishment.\n<\/p>\n<p>            Learned APP, on the other hand,          supported the<\/p>\n<p>impugned judgment. It is stated that there are concurrent<\/p>\n<p>findings of guilt recorded by learned two courts below which<\/p>\n<p>have not been shown to be perverse and\/or perfunctory and, as<\/p>\n<p>such, they do not merit any interference.\n<\/p>\n<p>              Having considered the submissions and after going<br \/>\n<span class=\"hidden_text\">                            3<\/span><\/p>\n<p>     through materials on record, this Court is satisfied that<\/p>\n<p>     submissions of learned counsel for the petitioner that<\/p>\n<p>     punishment, in the facts and circumstances of the case, seems to<\/p>\n<p>     be excessive has some force. Consequently, while maintaining<\/p>\n<p>     the conviction under section 323 IPC, the sentence so imposed<\/p>\n<p>     is reduced to R.I. for four months.\n<\/p>\n<p>                  With this modification in sentence, the application is<\/p>\n<p>     dismissed.\n<\/p>\n<\/p>\n<p>                               ( Kishore K.
