Having regarding<br \/>\nto the contents of the application, since the sufficient cause has<br \/>\nbeen made out, the delay occurred  in preferring Second Appeal<br \/>\ndeserves to be condoned. Even otherwise, the respondent has chosen to<br \/>\nremain absent and, therefore also, the Civil  Application has<br \/>\nremained unchallenged.\n<\/p>\n<p>\tIn that<br \/>\nview of the matter, the Civil Application is allowed. The delay<br \/>\noccurred in preferring Second Appeal is condoned. The Second Appeal<br \/>\nbe listed on board for hearing, if other objections are removed.
