    The prayer in this writ petition is to direct the<\/p>\n
1st and 2nd respondents to issue copy of Patta No.<\/p>\n
1367\/75,  copy  of  O.A.No.  50\/79,  1665\/76  and  Non-<\/p>\n
Encumbrance Certificate.   Petitioner claims ownership<\/p>\n
of certain properties and asserting her rights over the<\/p>\n
said properties and also a building, she had made<\/p>\n
complaints  to   various  authorities   including   the<\/p>\n
President of India and the Chief Minister of the State,<\/p>\n
which  were  forwarded   to  the   District  Collector,<\/p>\n
Palakkad  who  issued  Ext.   P23.    By   this  letter<\/p>\n
petitioner was informed that as she did not produce any<\/p>\n
document in support of her claims in the enquiry held<\/p>\n
by  the   Collector,  she   could   take  recourse   to<\/p>\n
proceedings before a civil court for establishing her<\/p>\n
right.  It is on receipt of this communication that<\/p>\n
this writ petition was filed with the prayers mentioned<\/p>\n
above.\n<\/p>\n
    2.   When the petitioner appeared in this Court as<\/p>\n
party in person, this Court directed the 1st respondent<\/p>\n
WPC No.27575\/07            -2-<\/span><\/p>\n
District Collector to file a statement and accordingly<\/p>\n
a statement on his behalf was filed by the learned<\/p>\n
Govt. Pleader and a copy thereof was served on the<\/p>\n
petitioner on 5-10-2007.\n<\/p>\n
    3.   In so far as patta No. 1367\/75 claimed by the<\/p>\n
petitioner is concerned, it is averred in the statement<\/p>\n
filed on behalf of the 1st respondent that though she<\/p>\n
had applied for the patta, on verification of the<\/p>\n
records in connection with SM No. 1367\/75, it was found<\/p>\n
that this pertains to one Kadukunny Nair Manjalloor<\/p>\n
P.O. and also Kolothu Parambil Kunjayamma, Amayoor<\/p>\n
P.O., Pattambi.  The 1st respondent would state that the<\/p>\n
properties   in these  cases  did  not  belong  to   the<\/p>\n
petitioner or her predecessors and the petitioner was<\/p>\n
totally unconnected with these cases.    Petitioner has<\/p>\n
not produced any document in this proceedings to prove<\/p>\n
that she has any connection with the cases referred to<\/p>\n
above or that she is entitled to the properties which<\/p>\n
are the subject matter of these proceedings.    If that<\/p>\n
be so, on the material available, it is not possible<\/p>\n
for this Court to find the statement to be incorrect<\/p>\n
for any reason.\n<\/p>\n
    4.   In so far as copy of O.A. 50\/79 and 1665\/76,<\/p>\n
WPC No.27575\/07           -3-<\/span><\/p>\n
are concerned, going by the writ petition these pertain<\/p>\n
to the properties claimed by the petitioner in various<\/p>\n
survey numbers in Oahalapally Village, Velanthavalam<\/p>\n
P.O., Palakkad District.     It is stated by the 1st<\/p>\n
respondent that the Tahsildar, Chittur after an enquiry<\/p>\n
had reported that the lands involved have already been<\/p>\n
disposed   to  various  persons  by  Shri.   Rengaswamy<\/p>\n
Chettiar and Smt. Krishnammal, the parents of the<\/p>\n
petitioner, as per document Nos. 1084\/85, 1085\/85,<\/p>\n
1086\/85 and 1087\/85 of the office of the Sub Registrar,<\/p>\n
Chittur.   It is also stated that another extent of 12<\/p>\n
cents of land in survey No. 1029\/3 was also disposed of<\/p>\n
by her parents and that as the mutation has not been<\/p>\n
carried out, the names of the previous owners continue<\/p>\n
to be denoted in the revenue records and it is on that<\/p>\n
basis the claim has been raised.\n<\/p>\n
    5. In so far as this prayer of the petitioner is<\/p>\n
concerned also, with the available materials, this<\/p>\n
Court will not be justified in granting the relief.<\/p>\n
While   the   petitioner claims   ownership  over   the<\/p>\n
properties in question the respondents would state that<\/p>\n
the properties have already been disposed of, that it<\/p>\n
is only on the basis that revenue records denoted the<\/p>\n

name of her parents that she is staking a claim in<\/p>\n
respect of the properties.      Thus, according to the<\/p>\n
respondents,   the   land  does   not  belong   to   the<\/p>\n
petitioner. Petitioner has not produced any document to<\/p>\n
accept her claim to the contrary.     In any case, what<\/p>\n
arises is essentially a dispute of title in respect of<\/p>\n
an immovable property. For establishing the right,<\/p>\n
parties are required to produce title deeds, adduce<\/p>\n
evidence and prove their case.   This cannot be done in<\/p>\n
proceedings under Article 226 of the Constitution.<\/p>\n
    6. It was irrespective of all these that following<\/p>\n
receipt of the representations made by the petitioner<\/p>\n
to various authorities     that the 1st respondent had<\/p>\n
conducted   an  enquiry  into  the  complaints  of   the<\/p>\n
petitioner.   On that occasion also petitioner could not<\/p>\n
produce documents to sustain her claim.   Though she has<\/p>\n
made several allegations I have no reason to think that<\/p>\n
the District Collector has any reason to not impartial<\/p>\n
or, to be prejudicial to the case of the petitioner, if<\/p>\n
she  has   a  genuine  grievance.    On  the   materials<\/p>\n
available I cannot say that the District Collector has<\/p>\n
exercised his powers in an arbitrary manner. In my<\/p>\n
view, in view of the failure of the petitioner to<\/p>\n

sustain her claim by producing documents the District<\/p>\n
Collector could only do what he has done in Ext.P23.<\/p>\n
    7. Be that as it may, even now if the petitioner<\/p>\n
has documents to sustain her claim, the 1st respondent<\/p>\n
shall examine the same and pass orders to redress her<\/p>\n
grievances.   However, the burden of establishing here<\/p>\n
case will be entirely on the petitioner and it is not<\/p>\n
for the authorities to search for her title and prove<\/p>\n
her case.\n<\/p>\n
    8. I do not find any justification for granting<\/p>\n
the relief sought for by the petitioner.  But, however,<\/p>\n
I clarify that if the petitioner is able to sustain her<\/p>\n
claim by producing documentary evidence, she may still<\/p>\n
approach the 1st respondent in which event the 1st<\/p>\n
respondent will consider her case and pass orders to<\/p>\n
remedy her grievances.\n<\/p>\n
    9.   Writ petition is disposed of as above.<\/p>\n
    Since   the  petitioner appeared   in  person,  the<\/p>\n
Registry will forward a copy of this judgment in her<\/p>\n
address in the writ petition.\n<\/p>\n<\/p>\n
