Thereafter, she was transferred at Otajina<br \/>\nChhapra and on 26th June 1996 she was transferred to<br \/>\nPrantiya Primary School. Thereafter, the petitioner<br \/>\nwas transferred at Isanpur Mota. On 11th February 2007,<br \/>\nthe petitioner<br \/>\nwas transferred back to Prantiya Primary School. Thereafter, vide<br \/>\nimpugned order, the respondent No.3 transferred the petitioner<br \/>\nto Jethluj Primary School, which is at a distance of about 60 kms.<br \/>\nfrom the residence of the petitioner.\n<\/p>\n<p>Hence, this petition.\n<\/p>\n<p>3.0\tMr.Pankaj<br \/>\nSoni, learned<br \/>\nadvocate for the petitioner,<br \/>\nhas relied upon the grounds raised in the petition and submitted that<br \/>\nthe impugned order of transfer is against the principles of natural<br \/>\njustice. It is submitted that with some ill-will or ill-motive the<br \/>\npetitioner<br \/>\nhas been transferred by the respondent No.3 by way of some monetary<br \/>\ngain.\n<\/p>\n<p>3.1\tIt<br \/>\nis submitted that the respondent No.3 has failed to consider the fact<br \/>\nthat the petitioner<br \/>\nhas been suffering from the disease of kidney failure and the medical<br \/>\ntreatment in that respect is going on. Further, it has not been<br \/>\nconsidered that the petitioner<br \/>\nis suffering from gynaec diseases. The respondent No.3 has also<br \/>\nfailed to consider that the widow mother-in-law of the petitioner,<br \/>\nwho resides with her, is also suffering from old age diseases. Hence,<br \/>\nit is submitted that the present petition is required to be allowed<br \/>\nby quashing and setting aside the impugned order.\n<\/p>\n<p>4.0\tMr.R.A.\n<\/p>\n<p>Rindani, the learned Assistant Government Pleader has submitted that<br \/>\nthe order passed by the respondent No.3 is just and proper. There is<br \/>\nno illegality or perversity in the order passed by the respondent<br \/>\nNo.3. Further, it is submitted that the order impugned in the<br \/>\npetition is an administrative order which is passed with a view to<br \/>\nmaintaining the decorum of the School Administration. Hence, the<br \/>\npresent petition is required to be rejected.\n<\/p>\n<p>5.0\tHaving<br \/>\nconsidered the rival contentions advanced by the learned<br \/>\nadvocates for the respective parties and the documents<br \/>\non record, it transpires that one preliminary report dated 13th<br \/>\nOctober 2009 was filed by the Bit Education Inspector. In pursuance<br \/>\nof the said preliminary report, the Deputy District Education Officer<br \/>\nsubmitted his report on 03rd December 2009 and the order<br \/>\nimpugned in the petition has been passed by the respondent No.3 after<br \/>\ntaking into consideration the said preliminary report as well as the<br \/>\nreport filed by the Deputy District Education Officer. It is<br \/>\npertinent to note that the action of the respondent No.3 in<br \/>\ntransferring the petitioner<br \/>\nto Jethluj Primary School from Prantiya Primary School is just and<br \/>\nproper since the said order is passed with a view to avoiding further<br \/>\npenal proceedings to be initiated against the petitioner.<br \/>\nIt is pertinent to note that the said order is passed as an<br \/>\nadministrative measure and it is not appropriate for this Court to<br \/>\ninterfere with any administrative orders passed by the respondent<br \/>\nNo.3. Further, there is no infirmity or illegality in the order<br \/>\npassed by the respondent No.3 and, therefore, I do not find it<br \/>\nnecessary to interfere with the order impugned since the same is<br \/>\npassed in accordance with law. I am in complete agreement with the<br \/>\nreasons assigned by the respondent No.3 while passing the said order.<br \/>\nHence, the present petition is required to be dismissed.\n<\/p>\n<p>6.0\tIn<br \/>\nview of aforesaid, the present petition fails and is, accordingly,<br \/>\ndismissed.
