    In Crime No.655\/2007 of Chengamanad Police Station<\/p>\n
registered for the offence under sections 397 and 365<\/p>\n
of Indian Penal Code  gold ornaments allegedly involved<\/p>\n
in the case was seized and produced before the court.<\/p>\n
So also articles including television set, DVD, Washing<\/p>\n
Machine, Furniture and Home theatre were seized from<\/p>\n
the house of fifth accused.  Petitioner is the de facto<\/p>\n
complainant.  Case of the petitioner is that 3.567 kilo<\/p>\n
grams of gold which was being transported in Ambassador<\/p>\n
car bearing reg. No.KL.01-AL-5356 on 11.8.2007 at about<\/p>\n
8.25 a.m, along the National Highway was stopped by a<\/p>\n
Qualis Jeep by five identifiable persons and the gold<\/p>\n
ornaments  were  forcibly  taken  away  and  petitioner<\/p>\n
thereby lost gold worth Rs.31.60,800\/-.      Petitioner<\/p>\n
filed Crl.M.P.220\/2008 under section 451 of Code of<\/p>\n
Criminal Procedure for interim custody of the articles<\/p>\n
seized including the articles seized from the house of<\/p>\n
the fifth accused, contending that those articles were<\/p>\n
purchased using the funds obtained by selling the gold<\/p>\n
Crl.M..C.458,460 & 463 of 2008      2<\/p>\n
belonging to the petitioner.         It is also contended that the<\/p>\n
gold ornaments seized and produced were identified by the<\/p>\n
petitioner as part of the stolen articles.<\/p>\n
       2.   Under     Annexure    C order  dated  21.01.2008  (in<\/p>\n
Crl.M.C.458\/2008) learned Magistrate dismissed the petition<\/p>\n
holding      that      in     view  of   the   order   passed   in<\/p>\n
Crl.M.P.160\/2008        whereunder  interim  custody  was  granted<\/p>\n
petitioner        cannot       be   granted,   interim    custody.<\/p>\n
Crl.M.C.458\/2008 is filed challenging that order.<\/p>\n
       3. Crl.M.C.463\/2008 is        filed challenging Annexure C<\/p>\n
order passed by the Judicial First Class Magistrate I,<\/p>\n
Aluva on 16.1.2008 in C.M.P.160\/2008 filed by the fifth<\/p>\n
accused the first respondent herein, whereunder            interim<\/p>\n
custody of the gold ornaments were given to the first<\/p>\n
respondent.\n<\/p>\n
       4. Crl.M.C.460\/2008 is filed challenging Annexure C<\/p>\n
order therein dated 22.12.2007 in C.M.P.4666\/2007 filed by<\/p>\n
the first respondent            the mother of the fifth accused.<\/p>\n
Under Annexure C order first respondent was granted interim<\/p>\n
custody of the articles seized from the house, though the<\/p>\n
learned Magistrate found that the evidence shows that the<\/p>\n
household items were purchased subsequent to the commission<\/p>\n
of the offence and the prosecution          case is that the said<\/p>\n
articles were purchased out of the funds obtained by sale<\/p>\n
Crl.M..C.458,460 & 463 of 2008      3<\/p>\n
of the stolen gold.\n<\/p>\n
       5. Though notice was served on the respective first<\/p>\n
respondent in Crl.M.C.460\/2008 and 463\/2008, the mother of<\/p>\n
the fifth accused, and the fifth accused, they did not<\/p>\n
appear.\n<\/p>\n
       6.    Learned counsel appearing for the petitioner and<\/p>\n
the learned Public Prosecutor were heard.<\/p>\n
       7.   Annexure C order in Crl.M.C.463\/2008 shows that the<\/p>\n
gold ornaments seized          as the stolen articles were granted<\/p>\n
on interim custody to the fifth accused for the sole reason<\/p>\n
that nobody else has claimed the article.            Case of the<\/p>\n
petitioner is that he was not informed about the petitions<\/p>\n
filed by either the fifth accused or his mother and in the<\/p>\n
application filed by the petitioner before the learned<\/p>\n
Magistrate,         prosecution   admitted  that  interim  custody<\/p>\n
could be given to the petitioner.          It is therefore argued<\/p>\n
that the orders granting interim custody to the fifth<\/p>\n
accused and the mother are to be quashed.<\/p>\n
       8.     Learned      Public Prosecutor  submitted  that the<\/p>\n
learned Magistrate should not have granted interim custody<\/p>\n
of the gold ornaments to the accused. In any case as claim<\/p>\n
of the petitioner was not considered,          learned Magistrate<\/p>\n
may be directed to consider all the petitions together.<\/p>\n
\n\n       9.      While     granting interim  custody  of  the   gold\n\nCrl.M..C.458,460 & 463 of 2008      4\n\n<\/pre>\n
ornaments, seized and produced before the court, to one of<\/p>\n
the accused,         learned Magistrate has stated that it is<\/p>\n
being given        as   no    other person  has  claimed   interim<\/p>\n
custody.      Learned Magistrate omitted to take note of the<\/p>\n
fact that the gold ornaments produced before the court were<\/p>\n
part of the stolen articles claimed to be that of the<\/p>\n
petitioner.       In such circumstance, before granting interim<\/p>\n
custody and that too, for the sole reason that no other<\/p>\n
claimant raised any claim,          learned Magistrate should have<\/p>\n
given notice        to    the   de facto  complainant.   Moreover,<\/p>\n
granting interim custody of gold ornaments to an accused<\/p>\n
for the reason that nobody else raised any claim for<\/p>\n
interim custody is not at all justifiable.               Therefore<\/p>\n
Annexure C order passed in C.M.P. 160\/2008 can only be<\/p>\n
quashed.\n<\/p>\n
       10. Similarly C.M.P.220\/2008 was dismissed for the sole<\/p>\n
reason that interim custody has already been ordered in<\/p>\n
C.M.P.160\/2008.           When   the order  in  C.M.P.160\/2008 is<\/p>\n
quashed, necessarily C.M.P.220\/2008 has to be reconsidered.<\/p>\n
       11. Though learned Magistrate granted interim custody<\/p>\n
of the articles seized from the house of the fifth accused<\/p>\n
to his mother on conditions, the de facto complainant was<\/p>\n
not heard before granting interim custody. When it is the<\/p>\n
case of the prosecution and the de facto complainant that<\/p>\n
Crl.M..C.458,460 & 463 of 2008      5<\/p>\n
those articles were purchased using the funds realised by<\/p>\n
the sale of the gold ornaments stolen from the petitioner,<\/p>\n
learned      Magistrate      should  have  given  notice  to  the<\/p>\n
petitioner in C.M.P. 4666\/2007 also.          As it is not done,<\/p>\n
Annexure C order in Crl.M.C.460\/2008 can only be quashed.<\/p>\n
       Petitions are allowed.       The orders in C.M.P.4666\/2007,<\/p>\n
C.M.P.160\/2008 and C.M.P. 220\/2008 on the file of Judicial<\/p>\n
First Class Magistrate Court-I, Aluva in Crime No.655\/2007<\/p>\n
of   Chengamanad       Police    Station are  quashed.     Learned<\/p>\n
Magistrate is directed to reconsider the applications and<\/p>\n
pass    appropriate       orders  in  accordance with  law  after<\/p>\n
hearing the parties including the petitioner.<\/p>\n
