No.1180 of 2011\n                    Raushan Kumar @ Gautam Kumar, son of Sunil Kumar,\n     resident of Mohalla-New Area, P.S.-Nawada (Town), District- Nawada.\n                                                            .........Petitioner\n                                               Versus\n                                       The State of Bihar .\n                                                          .......Opposite Party\n                                            -----------\n<\/pre>\n<p>3.      28.09.2011               The accused petitioner has preferred this<\/p>\n<p>                     revision application under Section 53 of the Juvenile<\/p>\n<p>                     Justice (Care and Protection of Children) Act, 2000<\/p>\n<p>                     against the order dated 19.08.2011 passed by the learned<\/p>\n<p>                     Sessions Judge, Nawada in Cr. Appeal (Juvenile)<\/p>\n<p>                     No.27\/2011 by which the order dated 1.08.2011 passed<\/p>\n<p>                     by the learned Juvenile Justice Board, Nawada in G.R.<\/p>\n<p>                     Case No.378\/2011, Trial No.258\/2011 arising out of<\/p>\n<p>                     Nawada (Town) P.S. Case No.99\/2011 under Sections<\/p>\n<p>                     341, 323, 324 and 307\/34 of the I.P.C. and Section 27 of<\/p>\n<p>                     the Arms Act has been confirmed and the prayer of the<\/p>\n<p>                     petitioner for grant of bail has been rejected.<\/p>\n<p>                                 Heard Mr. Aditya Prakash Sahay, the learned<\/p>\n<p>                     counsel for the petitioner and Mrs. I.B. Pandey, learned<\/p>\n<p>                     counsel for the State.\n<\/p>\n<p>                                 The main contention of the learned counsel<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>for the petitioner is that the petitioner was declared a<\/p>\n<p>juvenile by the learned Juvenile Justice Board vide order<\/p>\n<p>dated 23.05.2011. His prayer for bail was rejected by the<\/p>\n<p>Juvenile Justice Board vide order dated 1.08.2011.<\/p>\n<p>Against the said order, the petitioner preferred Cr.<\/p>\n<p>Appeal    (Juvenile)    No.27\/2011,      which   has   been<\/p>\n<p>dismissed by the impugned order on the ground that the<\/p>\n<p>release of the petitioner will bring him into association<\/p>\n<p>with known criminal and expose him to moral, physical<\/p>\n<p>and psychological danger and his release would defeat<\/p>\n<p>the ends of justice. He has further submitted that the<\/p>\n<p>petitioner has been in custody since 2.05.2011. He<\/p>\n<p>further submits that the petitioner has no criminal<\/p>\n<p>antecedent.\n<\/p>\n<p>              Learned counsel for the State could not<\/p>\n<p>controvert the contention of the petitioner while<\/p>\n<p>opposing the prayer of the petitioner.<\/p>\n<p>              After hearing the learned counsel for both<\/p>\n<p>the parties and on perusal of the materials on record, it<\/p>\n<p>appears that the contention of the learned counsel for the<\/p>\n<p>petitioner is correct. There is no material on record to<br \/>\n<span class=\"hidden_text\">                      3<\/span><\/p>\n<p>show that the release of the petitioner will bring him into<\/p>\n<p>association with known criminal and expose him to<\/p>\n<p>moral, physical and psychological danger and his release<\/p>\n<p>would defeat the ends of justice.\n<\/p>\n<p>           Considering the facts and circumstances<\/p>\n<p>stated above, in my opinion, the impugned order is not<\/p>\n<p>fit to be sustained. The impugned order is set aside. The<\/p>\n<p>petitioner above-named is directed to be released on bail<\/p>\n<p>on furnishing bail bond of Rs.10,000\/-with two sureties<\/p>\n<p>of the like amount each to the satisfaction of learned<\/p>\n<p>Juvenile   Justice       Board,   Nawada    in   G.R.     Case<\/p>\n<p>No.378\/2011, Trial No.258\/2011 arising out of Nawada<\/p>\n<p>(Town) P.S. Case No.99\/2011 on the following terms<\/p>\n<p>and conditions :\n<\/p>\n<p>           (i)                One of the bailors will be the<\/p>\n<p>                              mother of the petitioner.\n<\/p>\n<p>           (ii)               Mother of the petitioner will<\/p>\n<p>                              produce the petitioner in the<\/p>\n<p>                              court if and when required.\n<\/p>\n<p>           (iii)              The petitioner will not indulge<\/p>\n<p>                              in similar or in any other<br \/>\n<span class=\"hidden_text\">                           4<\/span><\/p>\n<p>                                   offence.\n<\/p>\n<p>                   (iv)            In case of his absence for two<\/p>\n<p>                                   consecutive dates or in case of<\/p>\n<p>                                   violation of the terms of the<\/p>\n<p>                                   bail, his bail bond will be<\/p>\n<p>                                   liable to be cancelled by the<\/p>\n<p>                                   learned Juvenile Justice Board<\/p>\n<p>                                   and he will be taken into<\/p>\n<p>                                   custody.\n<\/p>\n<p>              In the result, this application is allowed.<\/p>\n<p>V.K.
