DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 15\/07\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tThis<br \/>\napplication is filed under Section 439 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nC.R.No.I-177 of 2011 with Jamnagar City &#8220;A&#8221; Division<br \/>\npolice station, Dist: Jamnagar for the offences punishable under<br \/>\nSections 376 and 506(2) of the Indian Penal Code.\n<\/p>\n<p>\tHeard<br \/>\nlearned counsel for the parties and perused the record.\n<\/p>\n<p>\tConsidering<br \/>\nthe the statement of the victim and the complaint as a whole and the<br \/>\nconsensus, without discussing the evidence in detail, prima facie,<br \/>\nthis Court is of the opinion that this is a fit case to exercise the<br \/>\ndiscretion to enlarge the applicant on bail.\n<\/p>\n<p>\tHence,<br \/>\nthe application is allowed and the applicant is ordered to be<br \/>\nreleased on bail in connection with first information report<br \/>\nregistered at C.R.No.I-177 of 2011 with Jamnagar City &#8220;A&#8221;<br \/>\nDivision police station, on his executing a bond of Rs.5,000\/-<br \/>\n(Rupees five thousand only) with one surety of the like amount to the<br \/>\nsatisfaction of the trial court and subject to the conditions that he<br \/>\nshall<\/p>\n<p> i.\tnot<br \/>\ntake undue advantage of his liberty or misuse his liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injuries to the interest of the prosecution;\n<\/p>\n<p>surrender<br \/>\n\this passport, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>mark<br \/>\n\this presence at the concerned police station on the first Sunday of<br \/>\n\tevery month between 10 a.m. and 3 p.m till commencement of the<br \/>\n\ttrial.\n<\/p>\n<p>furnish<br \/>\n\tthe present  address of his residence to the I.O. and also to the<br \/>\n\tCourt at the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p>\tThe<br \/>\nAuthorities will release the applicant only if he is not required in<br \/>\nconnection with any other offence for the time being. If breach of<br \/>\nany of the above conditions is committed, the Sessions Judge<br \/>\nconcerned will be free to issue warrant or take appropriate action in<br \/>\nthe matter. Bail bond to be executed before the lower court having<br \/>\njurisdiction to try the case. At the trial, the trial court shall not<br \/>\nbe influenced by the observations of preliminary nature, qua the<br \/>\nevidence at this stage, made by this Court while enlarging the<br \/>\napplicant on bail.
