R.C.KODEKAR, APP for Respondent(s)\n: 1, \nNone for Respondent(s) :\n2, \n========================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.M.KAPADIA\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BANKIM.N.MEHTA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 03\/02\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.M.KAPADIA)<\/p>\n<p>RULE.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tR.C.Kodekar, learned APP appears and waives service of notice of<br \/>\n\tRule on behalf of the Respondent &#8211; State of Gujarat.\n<\/p>\n<p>Having<br \/>\n\tregard to the facts of the case, the application is taken up for<br \/>\n\thearing today.\n<\/p>\n<p>The<br \/>\n\t  applicant &#8211; convict prisoner, who,  vide    judgment    and<br \/>\n\torder dated 8.6.2006  rendered    in      Sessions   Case No. 10 of<br \/>\n\t2005 by     the     learned     Additional Sessions Judge, Godhra,<br \/>\n\thas   been convicted for the offence punishable under<br \/>\n\tSection 302 etc. of the Indian Penal Code and sentenced to<br \/>\n\timprisonment for life, has filed this application through jail<br \/>\n\tauthority, praying to enlarge him on temporary bail for a period of<br \/>\n\t30 days to enable him to  attend marriage ceremony of his daughter,<br \/>\n\twhich is scheduled on 7.2.2011.\n<\/p>\n<p>We<br \/>\n\thave considered the submissions advanced by Mr.R.C.Kodekar, learned<br \/>\n\tAPP for the Respondent &#8211; State of Gujarat and perused the<br \/>\n\taverments made in the application so also the jail remark sheet<br \/>\n\tforwarded by the jail authority along with the application.\n<\/p>\n<p>Upon<br \/>\n\tperusal of the jail remark sheet, we have noticed that the applicant<br \/>\n\thas undergone total period of 6 years 1 month and 8 days<br \/>\n\timprisonment and during the said period he has was enlarged on<br \/>\n\ttemporary bail on one occasion and has also enjoyed Furlough Leave<br \/>\n\ton two occasions and on all the occasions, he has surrendered in<br \/>\n\ttime.  Only on one occasion he has surrendered late by one day.<br \/>\n\tBesides this, on perusal of the marriage invitation card, we have<br \/>\n\tnoticed that the marriage of his daughter is fixed on 7.2.2011.\n<\/p>\n<p>In<br \/>\n\tview of this, if the Applicant convict is released on temporary bail<br \/>\n\tfor a period of 15 days from the date of his actual release, the<br \/>\n\tsame would meet the ends of justice.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, the Application succeed in part and and is<br \/>\n\taccordingly partly allowed.  The Applicant &#8211; Convict &#8211;<br \/>\n\tRAYAJIBHAI DHULABHAI is<br \/>\n\tordered to be released on temporary<br \/>\n\tbail for a period of 15 days from the date of his actual release on<br \/>\n\texecuting a personal bond of Rs.5,000\/- before the jail authority on<br \/>\n\tusual terms and conditions. The applicant shall surrender to the<br \/>\n\tjail authority on completion of 15 days from the date of his release<br \/>\n\twithout fail.  During the period of temporary bail, the applicant<br \/>\n\tshall not abuse the liberty granted to him and shall maintain law<br \/>\n\tand order.
