P.\nIndustrial  Disputes  Act, 1947, expired on  the  9th  June,\n1951.\tThe Government extended the period up to 30th  June,\n1951.  The 30th June was a public holiday and 1st July was a\nSunday\tand the Industrial Tribunal pronounced its award  on\nthe 2nd July:\n  Held,\t that an Industrial Tribunal to which a\t dispute  is\nreferred under the U. P. Industrial Disputes Act, 1947, is a\n\"  Court \" within the meaning of s. 10 of the  U.P.  General\nClauses\t Act, 1904, and, as the 30th June and 1st July\twere\nholidays,  the\taward  pronounced on the 2nd  July  was\t not\ninvalid on the ground that it was not pronounced within\t the\nperiod fixed.\n273\n\n\n\nJUDGMENT:\n<\/pre>\n<p>CIVIL  APPELLATE JURISDICTION: Civil Appeal No. 65 of  1952.<br \/>\nAppeal from an award dated 17th November, 1951, made by\t the<br \/>\nLabour Appellate Tribunal of India, Calcutta, in Appeal -No.<br \/>\nCal. 280 of 1951.\n<\/p>\n<p>K. The Judgment of the Court was delivered<br \/>\nby<br \/>\n   BHAGWATI J.-This is an appeal by special  leave  against<br \/>\nthe  decision  of the Labour Appellate\tTribunal,  Calcutta,<br \/>\nupholding  the award made by the State Industrial  Tribunal,<br \/>\nUttar Pradesh, with certain modifications.<br \/>\n  An  industrial dispute arose between the  appellant,\tthe<br \/>\nVishwamitra  Press Karyalaya, Kanpur, and  the\trespondents,<br \/>\nthe  workers of the Vishwamitra Press as represented by\t the<br \/>\nKanpur Samachar Patra Karamchari Union, Kanpur, in regard to<br \/>\nthe alleged victimisation of certain workmen under the guise<br \/>\nof  &#8216;retrenchment.  That industrial dispute was referred  to<br \/>\nthe  Industrial Tribunal, by a notification dated  the\t24th<br \/>\nApril,\t1951.  The time for making the award expired on\t the<br \/>\n9th  June,  1951,  and\ton the 9th  June.  1951,  a  further<br \/>\nnotification  was issued extending the time for\t making\t the<br \/>\naward up to the 30th June, 1951.  The 30th June, 1951, was a<br \/>\npublic\tholiday\t and  the  1st\tJuly  was  a  Sunday.\t The<br \/>\nIndustrial  Tribunal made its award on the 2nd\tJuly,  1951,<br \/>\nand pronounced it in open court on that day.  It was however<br \/>\nthought\t by the Uttar Pradesh Government that the award\t was<br \/>\nbeyond\ttime  and  invalid and on the  18th  July,  1951,  a<br \/>\nnotification  was issued extending the period up to the\t 3rd<br \/>\nJuly,  1951.   This award was challenged  by  the  appellant<br \/>\nbefore the Labour Appellate Tribunal.  The Labour Appellate.<br \/>\nTribunal  negatived the Contentions of the  appellant.\t The<br \/>\nappellat applied<br \/>\n<span class=\"hidden_text\">274<\/span><br \/>\nfor  special  leave which was granted by this Court  on\t the<br \/>\n21st December, 1951, limited to the following<br \/>\ngrounds:\n<\/p>\n<p>  &#8221;  (1) The Government had no power to extend the time\t of<br \/>\nthe making of award after the expiry of the time  originally<br \/>\nfixed, and the award made by the Adjudicator after such time<br \/>\nis illegal, ultra vires, inoperative and void.<br \/>\n  (2)In\t any case the State Government I had  extended\tthe<br \/>\ntime  for  making the award till 30th June,  1951,  and\t the<br \/>\nAdjudicator&#8217;s award made after that<br \/>\ndate is void.\n<\/p>\n<p>  (3)That the extension of time by the Government on.  21st<br \/>\nJuly,  1951,  after even the time  extended  previously\t had<br \/>\nexpired, was ultra vires, and it could not make a void award<br \/>\na valid award.&#8221;\n<\/p>\n<p>  The industrial dispute which arose between the  appellant<br \/>\nand  the  respondents  was referred  by\t the  Uttar  Pradesh<br \/>\nGovernment  to\tthe Industrial Tribunal in exercise  of\t the<br \/>\npowers\tconferred by sections 3 and 4 of the  Uttar  Pradesh<br \/>\nIndustrial Disputes Act, 1947.\tThe Uttar Pradesh Government<br \/>\nhad in exercise of the powers conferred by section 3 (d)  of<br \/>\nthe  Act promulgated an order inter alia providing  for\t the<br \/>\nadjudication  of the industrial disputes referred by  it  to<br \/>\nthe Industrial Tribunals.  Paragraph 16 of that order ran as<br \/>\nunder :-\n<\/p>\n<p>  &#8221; The Tribunal or the Adjudicator shall hear the  dispute<br \/>\nand  pronounce\tits  decision  within  40  days\t  (excluding<br \/>\nholidays  observed by courts subordinate to the High  Court)<br \/>\nfrom  the  date\t of  reference\tmade  to  it  by  the  State<br \/>\nGovernment, and shall thereafter as soon as possible  supply<br \/>\na  copy\t of the same to the parties to the dispute,  and  to<br \/>\nsuch other persons or bodies as the State Government may  in<br \/>\nwriting direct.\n<\/p>\n<p>  Provided  that the State Government may extend  the  said<br \/>\nperiod from time to time.&#8221;\n<\/p>\n<p> Paragraph  9 which prescribed the powers and functions\t of<br \/>\nTribunals inter alia provided:-\n<\/p>\n<p><span class=\"hidden_text\">275<\/span><\/p>\n<p> &#8220;(9).\t The  decision shall be in writing,  and  shall\t be<br \/>\npronounced in open court and dated and signed by the  member<br \/>\nor members of the Tribunal, as the case may be, at the\ttime<br \/>\nof pronouncing it.&#8221;\n<\/p>\n<p> It  was  not disputed before us that the  original  period<br \/>\ncalculated in accordance with paragraph 16 above expired  on<br \/>\nthe 9th June, 1951, and the Uttar Pradesh Government validly<br \/>\nextended  the  period  up to the 30th June,  1951.   It\t was<br \/>\nhowever\t contended that the Industrial Tribunal should\thave<br \/>\nmade  its award on the 30th June, 1951, and not on  the\t 2nd<br \/>\nJuly,  1951, as it purported to do.  It was urged  that\t the<br \/>\nprovision  as  to  excluding  holidays\tobserved  by  courts<br \/>\nsubordinate to the High Court which obtained in paragraph 16<br \/>\nabove  did  not apply when the period was extended up  to  a<br \/>\nparticular  date.   It would apply only if  the\t period\t was<br \/>\nextended by a particular number of days when for the purpose<br \/>\nof the computation of those days the holidays would have  to<br \/>\nbe  excluded  in the manner therein  mentioned.\t  The  Uttar<br \/>\nPradesh\t Government  having extended the period up  to\tthe,<br \/>\n30th  June,  1951, it was submitted that the  award,  should<br \/>\nhave  been made by the 30th June, 1951, and, not  later\t and<br \/>\nhaving been made on the 2nd July, 1951, was therefore beyond<br \/>\ntime and invalid.\n<\/p>\n<p>  This\targument  might\t well have prevailed  but  for\tthe<br \/>\nprovisions  of section 10 of the U. P. General Clauses\tAct,<br \/>\n1904.  That section provides:-\n<\/p>\n<p> &#8221;  Where,  by\tany  United  Provinces\tAct,  any  act\t or<br \/>\nproceeding is directed or allowed to be done or taken in any<br \/>\ncourt  or  office on a certain day or  within  a  prescribed<br \/>\nperiod, then, if the court or office is closed; on that\t day<br \/>\nor  the\t last  day  of the prescribed  period,\tthe  act  or<br \/>\nproceeding shall be considered as done or taken in due\ttime<br \/>\nif  it is done or taken on the next day afterwards on  which<br \/>\nthe court or office is open.&#8221;\n<\/p>\n<p>The  Industrial\t Court was closed on the  30th\tJune,  1951,<br \/>\nwhich  was declared a public holiday.  The 1st\tJuly,  1951,<br \/>\nwas  a Sunday and it was competent to the &#8216;Industrial  Court<br \/>\nto pronounce its decision on the next<br \/>\n<span class=\"hidden_text\">276<\/span><br \/>\nafterwards  on which the Industrial Court was n,  i.e.,\t the<br \/>\n2nd  July,  1951.   Prima facie therefore  award  which\t was<br \/>\npronounced on the 2nd July, 1, was well within time.<br \/>\n The  only  thing  which  Shri\tKhaitan\t counsel  for\tthe<br \/>\nappellant urged before us therefore was that the  Industrial<br \/>\nCourt  was not a court within the meaning of section  10  of<br \/>\nthe U. P. General Clauses Act, &#8220;The court&#8221; according to\t his<br \/>\nsubmission  could  only\t be construed mean a  court  in\t the<br \/>\nhierarchy  of the civil courts the State and  an  Industrial<br \/>\nCourt  did  not fall hin that category.\t We  are  unable  to<br \/>\naccept\tthis intention of Shri Khaitan.\t The  Uttar  Pradesh<br \/>\nindustrial  Disputes Act, 1947, was an Uttar Pradesh t.\t The<br \/>\nGeneral\t Order\tdated the 15th March, 1951,  which  provided<br \/>\ninter  alia for the reference of the industrial dispute\t for<br \/>\nadjudication   and  the\t manner\t in  which  it\twas  to\t  be<br \/>\nadjudicated,  was  promulgated\tby e  U.  P.  Government  in<br \/>\nexercise of the powers conferred upon it by section 3 (d) of<br \/>\nthe  Act.  Paragraph (9) of the General Order  provided\t for<br \/>\nthe  decision  ing pronounced by the Industrial Tribunal  in<br \/>\nopen   urt  and we fail to understand how it could  ever  be<br \/>\nged that the Industrial Tribunal was not a  court ithin\t the<br \/>\nmeaning\t of section 10 of the U. P. General lauses Act.\t  If<br \/>\nthe  Industrial Tribunal was thus a ourt within the  meaning<br \/>\nof section 10 of the U. P. General Clauses Act the court was<br \/>\nclosed on the 30th ane, 1951, as also on the 1st July, 1951,<br \/>\nand  the decion could be pronounced by the Industrial  Court<br \/>\non i.e next day afterwards on which it was open, i.e., on ne<br \/>\n2nd July, 1951.\t In our opinion therefore the ecision  which<br \/>\nwas  pronounced on the 2na July, 951, &#8216;was well within\ttime<br \/>\nand was valid and binding&#8217; in the parties.<br \/>\n The  above decision is determinative of this  appeal,\tand<br \/>\nthe appeal will therefore stand dismissed with costs.\n<\/p>\n<p>\t\t Appeal dismissed.\n<\/p>\n<p>Agent for the appellant: B.
